For this request, you are seeking "All written communications and
notes of conversations between Vincent Myers and Cherry Hill Twp
from 1/1/24 to 7/9/24."
In MAG Entm't, LLC v. Div. of Alcohol Beverage Control, 375 N.J.
Super. 534 (App. Div. 2005), the Court held that OPRA "is not
intended as a research tool litigants may use to force government
officials to identify and siphon useful information. Rather, OPRA
simply operates to make identifiable government records 'readily
accessible for inspection, copying or examination.'". Under OPRA,
agencies are required to disclose only "identifiable" government
records not otherwise exempt. In short, OPRA does not countenance
open-ended searches of an agency's files.
Moreover, pursuant to New Jersey P.L. 2024, c. 16, which states
that, as of September 3, 2024, a custodian is not required to
fulfill a request for records, including but not limited to mail,
email, text messages, correspondence, or social media postings and
messages, if the request does not specify an individual(s) or job
title, account to be searched, specific subject matter, and is not
limited to a reasonable and defined time period. Therefore, please
identify the subject matter and the email address of Vincent
Myers.
In addition, the Township of Cherry Hill reserves all of its
rights enunciated in OPRA, including, but not limited to, the
imposition of a special service charge as well as an extension of
time to respond.
