This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:

Permitted Use

Was the permitted use for the property commonly known as 435 Lincoln Ave., Manville, NJ 08835 (“Property”) single-family or multi-family as of 6/12/2020?

In addition, please provide me with all records concerning non-conforming use determinations/certificates/exceptions with respect to the Property including but not limited to the following:

• Any certificate of or permission regarding nonconforming use with respect to the zoning of the Property being for single-family or multi-family;

• Records concerning the zoning status of the Property as of 06/12/2020 with respect to the number of families permitted to occupy the Property, including any zoning maps;

• All maps, documents, emails, minutes, and determinations related to any such certificate of nonconforming use concerning the number of families permitted to occupy the Property or any other aspect of the Property’s zoning.

(Generally, a nonconforming use arises when there is a change to the zoning, but an existing use is still permitted to continue by the local authority.)

If a change in zoning from single-family to multi-family were in fact ever made, was such zoning change granted by the Land Use Board or any other local authority with jurisdiction over such matter?

Comprehensive zoning and permit records for the Property

In addition, I am seeking comprehensive information, including but not limited to copies of all documents submitted or processed in relation to the zoning and permitting for this Property, including but not limited to the following:

Zoning Records:

• Copies of zoning maps, codes, and regulations applicable to the Property;
• Zoning permits, variances, special use permits, or exceptions related to the Property;
• Records of any zoning violations, citations, or enforcement actions related to the Property; and resolution thereof;
• Correspondence and communications between the Property owner and the zoning department staff.

Permit Records:

• Building permits for construction, renovation, or any other related activities at the Property;
• Electrical, plumbing, or other trade permits issued for the Property;
• Applications, records of inspections, approvals, and completion certificates associated with any permits for the Property;
• Any records related to the issuance, denial, or revocation of permits for the Property.
