voter participation records in Millstone Township New Jersey

Response to this request is long overdue. By law, under all circumstances, Monmouth County Board of Elections should have responded by now (details). You can complain by requesting an internal review.

Dear Monmouth County Board of Elections,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

List of voters who voted in the last Primary

Party affiliation (Democratic / Republican / Unaffiliated at time of vote)

Municipality / voting district

Voting history (which elections they voted in — not how they voted)

Registration date

My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.

Dear Dan:

 

The Monmouth County Superintendent of Elections has a standing policy of
all OPRA requests being filtered through the NextRequest website.  Having
all the OPRA requests in one place allows us to keep track of all requests
submitted and also makes them easily searchable, particularly in the event
of an audit.  I have requested permission to enter your request which has
been granted.  I will e-mail the list(s) to you, but you will also get an
e-mail notification from NextRequest notifying of the availability to
access your requested information.

 

I need some clarification please.  Do you want the voter history list
separate from the last Primary list or would you prefer just one list with
all the information?  Only 5 elections can be selected for a list.  I need
to know very specifically which elections you want included - e.g., 2024
General, 2021 Primary.

Pursuant to [1]NJ P.L. 2020, c.125 (A1649 3R) a.k.a.
Daniel's Law address information for protected voters has
been removed.

Please be advised that voter registration is fluid and
changes daily. Therefore, any and all request for voting
records or voter registration will not be an accurate
“snapshot in time”, and your records request may differ
significantly today than from any previous election
histories.

[2]NJSA 19:31-18.1(c) Registry lists; distribution;
availability, use

“No person shall use voter registration lists or copies
thereof prepared pursuant to this section as a basis for
commercial or charitable solicitation of the voters listed
thereon. Any person making such use of such lists or copies
thereof shall be a disorderly person, and shall be punished
by a fine not exceeding $500.00.”

N.J.S.A. 47:1A-1.1 excludes the disclosure of “personal
identifying information” which it defines as:

“...information that may be used, alone or in conjunction
with any other information, to identify a specific
individual. Personal identifying information shall include,
but shall not be limited to, the following data elements:
name, social security number, credit card number, debit
card number, bank account information, month and day of
birth, any personal email address required by a public
agency for government applications, services, or programs,
personal telephone number, the street address portion of
any person's primary or secondary home address, or driver
license number of any person.”

In a recent policy change due to an abundance of caution to
protect the voter’s record, we no longer give this
information to anyone other than the voter.
