Records requested:

Governor Murphy’s executive order number 175 states in part:

“Public school districts that determine that they cannot provide in-person instruction pursuant to Paragraph 7 of this Order must submit documentation to the Department of Education that identifies:

a. The school building(s) or grade level(s) within the district that will provide full-time remote instruction;
b. The specific health and safety standard(s) listed in Paragraph 2 of this Order that the school is unable to satisfy;
c. The school’s anticipated efforts to satisfy the identified health and safety standard(s); and
d. A date by which the school anticipates the
resumption of in-person instruction.
Such documentation must be submitted at minimum one week prior to the public school district’s first day of school.”

Please provide any documentation or certification that was provided to the New Jersey Department of Education explaining why the Cherry Hill School district is doing full remote learning.

Did the school district not keep a copy of the information they provided to the Department of Education? I imagine that while you may not have a response from the Google Form, you have a record of what information you provided to the DOE. Please provide that information.

Please pass this on to the person who conducts Open Public Records Act reviews.

I am writing to request an internal review of Cherry Hill Board of Education's handling of my OPRA request 'Virtual Learning Certification Request'.

We previously requested “any documentation or certification that was provided to the New Jersey Department of Education explaining why the Cherry Hill School district is doing full remote learning.”

You responded:

The form that was submitted to the Department of Education indicating the District's status for remote learning was a fillable Google document. It was completed and submitted via Google but a copy was not provided to the District.

While I appreciate you were not provided a copy of the form you filled out, you still provided information to the DOE; presumably that information was determined by and recorded by the School District prior to submission. To clarify, it is that information that was requested and that information you have failed to provide.

Please provide the information provided to the DOE that justifies the District’s reason for full remote learning. That information is acceptable as a pdf, word document, Google document, etc.

It’s unfortunate that you’ve made no attempt to fulfill this OPRA request. Of course, based on the school districts inept handling of the pandemic, your failure to perform your duty was not unexpected.

As your response noted, the school district did not see fit to maintain a copy of the information submitted to the state; fortunately for the district, the state does honor its obligation to properly maintain records and fulfill OPRA requests.

Should the district every find itself engaged in litigation, the records you chose not to maintain can be found below.
