I am writing to request an internal review of Tuckerton Borough's handling of my OPRA request 'Violation Notices & Related Court documents against 61 Admiral Dr.'.
On Jan 23th, at 8:08AM we reached out to the borough for an update on our OPRA request from Jan 16th. The Deputy Zoning Officer, Mr. James McAndrew, explained on the telephone that he was working on the request and we would be receiving the response by that Wednesday, Jan 18th.
We sent a request for an updated status on Jan 26th, waited a week after the proposed date Mr. McAndrew said he would email the documents requested by. It has been now almost 3 weeks since then and we have not received an update here, or via email, on our OPRA request.

I believe that was something on me, but I will look into the situation and get back to you. I do know that your request was vague and required research which is not an acceptable OPRA request, you have to be specific on records when you request copies. I also know that he should have emailed you the violation notices, but again I will review and get back to you ASAP

When I spoke with Mr McAndrew the phone on Jan 16th, he didn't indicate any need for clarification and knew what was being requested. He also mentioned that there was a "book" of violations on this address and is very familiar with the property. He says "He has a long history with this address". So I didn't think any research would need to be done with getting this together, specially not this long. A month later.
Please clarify how more specific the request needs to be other then requesting for violations and related court documents against this address since 1990. That was never discussed via the phone with Mr. McAndrew, and the only other way I could be more specific is if I had the violations documents I requested. Then I would know what court documents to request by date or case number by violation.

Court documents have to be requested through the Court Administrator, OPRA does not cover court documents. Her phone number is 609-296-2036. I am the custodian of records not Mr. McAndrew he is not required to answer questions on OPRA. I will have him forward you the violations that are current, but as for going back into records we are not required to do that. You would have to give us violation numbers and specific dates. It is not something we have readily available from 1990. Please look for an email soon with the current violation notices.

No one answered here with my inquiry a month ago, and explained all of this. And when I followed up with a phone call to Mr. McAndrew he updated on this request with the information I just told you. Regardless of Mr. McAndrews not being required to answer questions about OPRA requests, he did when I called and no one else did until today..
I am requesting more then the "current" violations towards this address. And Mr. Andrews has already stated he had this documentation via our phone conversation dating back to the 1990's, which would make it readily available? But you are not required under OPRA to provide me with those past violations against this address? So if it's not "current" violation you don't have to fill those requests?
I didn't have any issues with my OPRA request of past police records with Tuckerton Police Department that was requested last year, they did not require "certain dates" and violation numbers. I gave them as much information as I could, and the request was responded to me via email promptly. All I have them was a name and year to year time frame.
Please send me the municipal email for the court administrator? It is not listed on the borough's website. I would like to make contact via email, to keep the conversation and requests transparent, and to avoid any confusion. Because there seems to be some already with this OPRA request.

Police department records are different as is court they are not under the Open Public Records Act.
