Records requested:

Good Evening,

Under the OPRA, I would like to obtain surveillance
video from the date of Derek Armstead's visit to the
Union County administration building on October
31,2019. This specific instance of entrance was in
between 3:45-4:15pm at the front door of the Union
County Administration Building lobby. I would also
like to see any surveillance available on the 3rd floor
during the same time frame. Any and all camera
views showing Derek's Armstead should be
included. I would also like to view him leaving the
building at whatever time he did so.

Re:           Open Public Records Act (OPRA) Request Acknowledgment

This office received your OPRA request for surveillance video of Derek
Armstead’s visit to the Union County Administration Building on 10/31/19
between 3:45-4:15 p.m. on January 8, 2020. OPRA requires that a response
be provided within 7 business days, beginning the first business day after
receipt of the request. We will have a response prepared by January 17,
2020. Records are typically provided to requestors in electronic format,
usually at no cost (see below for additional information). However, the
County will advise you of the page count and cost, if you wish to buy
paper copies. You may also review documents at no cost in the Clerk of the
Board’s Office; if you choose this option, please call or email ahead to
arrange a mutually convenient appointment.

Pursuant to Ordinance 710-2010, adopted on October 14, 2010, the following
fee schedule applies for photocopies: pages 1-10: no charge; page 11 and
each page thereafter: $.05 per page for documents that are letter-sized or
smaller, and $.07 per page for documents that are legal-sized or
larger. There shall be a limit of 30 pages forwarded via facsimile to any
requestor, per request. The fee schedule is as follows: pages 1-10: no
charge; pages 11-30: $.05 per page for letter-sized documents, and $.07
per page for legal-sized documents.

If you wish to have records mailed or faxed to you and there is a cost for
same, please send your payment to the following address:

Office of the Clerk of the Board

Union County Administration Building – 6^th Floor

10 Elizabethtown Plaza

Please do not send cash; kindly make a check or money order payable to the
County of Union. We will provide the documents upon receipt of payment.

OPRA ordinarily grants immediate access to budgets, bills, vouchers,
contracts (including collective negotiations agreements and individual
employment contracts), and public employee salary and overtime
information. While the County makes every effort to provide immediate
access to such documents, processing may take longer depending on the
amount of records requested, medium requested, if redaction is required or
documents are in storage, or if the request requires extensive work to
complete. The same is true for requests for non-immediate access
documents. When additional time is needed to process a request, the County
provides requestors with written updates accordingly.

In accordance with OPRA, requests that require extensive work to complete
may be subject to a special service charge in addition to applicable copy
fees and/or archive fees ($2/box). Special service fees are determined on
a case-by-case basis; you will be informed of same before incurring the
charge. Please be advised that work on such requests will not begin until
receipt of the special service charge and/or archive fees.

If no records are available, or the record(s) are exempt in accordance
with OPRA, the County will advise accordingly.

If your OPRA request is denied, you have a right to appeal the decision.
You may file your appeal with the New Jersey Government Records Council
(GRC) or the New Jersey Superior Court, as provided by N.J.S.A. 47:1A-6
and 7. For additional information on the appeal process, please visit:

Thank you in advance for your anticipated cooperation and patience while
we work to fulfill your request. If you have any questions, please call
this office at (908) 527-4178 or (908) 527-4157.

Opra, Union County

Dear Mr. MH,

This email constitutes a formal and complete response to your January 8,
2020, OPRA request for surveillance video of Derek Armstead’s visit to the
Union County Administration Building on October 31, 2019.

Please be advised that the retention period for such video is between
21-31 days. Unless there is a preservation request or the County is
otherwise advised, footage is not retained beyond the system’s standard
retention periods. The length of time between the date of the visit and
the date of your request exceeds the retention period; as such, there is
no video to provide. Additionally, in the event the footage had been
retained, same would be exempt as to the security exception in OPRA.

Thank you for your attention to this matter.

Marlena
