Dear Englishtown Borough,
Our organization is aware Englishtown Councilman Daniel Francisco used a video camera to record the March 9, 2022 Englishtown Borough Council Meeting.
Since this was done during the open public sessions of Englishtown Borough Council Meetings, according to Open Public Records Act (N. J. S. A. 47-1A1 et seq.), he has created a public record which is subject public inspection and review.
Our organization, therefore, is requesting:
* An unedited copy of all files stored on the camera and the chip/SD Card used to capture the recording.
* A screen capture of all folders from the camera used and/or the SD/media card used (A screen capture of the folders will suffice).
The files can be transferred to an online folder operated by our organization.

respond to your request is May 12, 2022. This response to your request is
being provided to you on the 4th business day after the custodian’s
receipt of said request.
Your request sought access to:

Since this was done during the open public sessions of Englishtown Borough
Council Meetings, according to Open Public Records Act (N. J. S. A. 47-1A1

Your request requires additional time beyond the seven (7) business days
to fulfill as it is not kept on site. OPRA allows custodians to seek
extensions of time pursuant to N.J.S.A. 47:1A-5.i. Specifically, OPRA
states that, “the requestor shall be advised by the custodian when the
record can be made available. If the record is not made available by that
time, access shall be deemed denied.” Your request requires an extension
of time until June 6^th, 2022. If your request for access to a government
record has been denied or unfilled within the seven (7) business days
required by law, you have a right to challenge the decision by the Borough
of Englishtown to deny access. At your option, you may either institute a
proceeding in the Superior Court of New Jersey or file a complaint with
the Government Records Council (GRC) by completing the Denial of Access
