Verification of Dana Cedars Authorization to respond to OPRA

Dear North Haledon Borough,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Pursuant to N.J.S.A. 47:1A-1 et seq., I request copies of the following records:

1. Any records identifying the officially designated Records Custodian for the Borough of North Haledon from August 1, 2025 through present.

2. Any records reflecting whether Dana Cedar was authorized to:
- respond to OPRA requests,
- act on behalf of the Records Custodian,
- review records for release,
- perform redactions,
- or transmit OPRA responses.

3. Any delegation records, policies, memorandums, or directives concerning Dana Cedar’s authority relating to OPRA responses.

4. Any records identifying which individual(s) reviewed, approved, or authorized the response and redactions associated with my OPRA request regarding North Haledon municipal/police fleet vehicles.

5. Any OPRA policies or procedures governing:
- redaction decisions,
- release authorization,
- and delegation of Records Custodian responsibilities.

If any portion is denied, please provide the specific statutory exemption relied upon and the name/title of the individual making the determination.

According to NJSA 47:1A-1 et seq. provides that the custodian of government records is the municipal clerk. The Borough follows the state statute, therefore there are no other policies.

The custodian of records has the ability to redact non-disclosable information under the guidelines of NJSA 47:1A-5(g)

Thank you for your response.

My request sought existing government records, not an explanation of the Borough’s interpretation of N.J.S.A. 47:1A-1 et seq.

Your response states that the Municipal Clerk is the Custodian of Government Records under the statute. However, it does not indicate whether any records exist appointing, designating, or authorizing the current Custodian of Government Records, or documenting any transition in that role. Subsequent OPRA responses have identified Colleen Carver as the Borough’s Custodian of Government Records.

Accordingly, please clarify whether any existing records appointing, designating, authorizing, or otherwise establishing Colleen Carver as the Borough’s Custodian of Government Records exist, including any resolution, ordinance, appointment letter, memorandum, delegation, personnel action, or other official record establishing that designation and its effective date.

If no responsive records exist after a reasonable search, please confirm that no such records were located.
