Dear Neptune Township,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

1. A fleet list of all township vehicles and the personnel assigned to vehicles where applicable.

2. Log of vehicles that have been used by employees not assigned to a vehicle but able to use, such as Council members taking a vehicle for a conference for years 2022-present.

3. All purchase orders from 2020- Present for clothing purchases. Please separate by department if possible.

4. All purchase orders from 2020- Present for reimbursements made to Council Members and employees for classes, clothing, conferences, etc. If there is not a way to differentiate why the reimbursements were made, please provide all purchase orders that were issued to employees or council members from 2020-Present

5. All union contracts from 2020- present.

6.All confidential employee contracts from 2020- Present

7. All purchase orders for Council members to attend conferences, seminars, or gatherings from 2020- Present.

8. Employee list and accompanying salaries for all employees during the years 2020- present. Please include full name, department, salary, and reason for leaving position.

My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.

Which is not required, however, you have not provided all of the
information required on the form nor have you indicated that the request
is anonymous.
You must either provide all of the information requested on the form or
indicate that this an anonymous request. Failure to do so will result in
your request being rejected. Please note, if you choose to make your
request anonymously, you not be able to file any complaint with the
Government Records Council nor lawsuit in Superior Court to challenge the
township's response.
 
Specifically, NJSA 47:1A-5 now reads (emphasis added) : A request shall be
submitted by a requestor in the form adopted by the custodian and the
custodian may deny a request that is incomplete, except that a requestor
indicating the request is being submitted anonymously shall not be grounds
for denial. A completed form adopted by the custodian, a letter, or an
email from a requestor including all of the information required on the
adopted form shall suffice in place of a completed form as a valid
government record request. If the letter or email from a requestor
includes substantially more information than required on the adopted form
and requires more than reasonable effort to clarify the information, the
custodian may deny the request. If a letter or an email from a requestor
does not include all of the information required on the adopted form, the
custodian may deny the record request. A request may be submitted
anonymously provided, however, that anonymous requestors shall not be
permitted to institute proceedings pursuant to section 7 of P.L.2001,
c.404 (C.47:1A-6). A request that is submitted anonymously shall not be
considered incomplete.
Please also note that the types of records which are considered immediate
access but are more than 24 months old are not considered immediate
access. (NJSA 47:1A-5) Immediate access to government records shall not be
required to be granted for documents over 24 months old.
Please advise so that we can move forward with your request .

Good morning, I have provided the reason with details and the actual law in my previous email.
J. Klein falls short of Full name, address, email, phone, as indicated on the OPRA form.

You don’t have to provide those details. You can make an anonymous request but have to indicate as much. Otherwise, your request will be denied.
Please also note, anonymous requestors don’t have the option to file complaints regarding their requests.

Please provide the requested ID information or indicate this is an anonymous request or consider your request denied.

Dear William Bray,
This request is an electronic request sent by email. You have name and email. All responses to OPRA must be in writing so there is no need to provide a phone number and since I want the records delivered electronically, providing a physical address is not necessary. The law does not require me to provide the details you are requiring. So again, this is not anonymous and the request is a valid OPRA request. Please proceed accordingly.

Further, I would like to add to my request for all OPRA requests submitted between 2022- present with the response provided by the Township.

In looking at just requests on OPRA machine since you have not responded to the request for OPRas and their responses, there are multiples where no full names were used, initials or just first name was provided, use of the OPRAmachine request email and no physical address were provided and you responded with no issue arguing for anonymity. Feel free to answer why these requests are being handled differently than the request that I have submitted.
