This is a request for public records made under OPRA and the common law right of access.

1) Date of Hire for Police Officer Frank Moschella.
2) Date of Hire for Police Sergeant Daniel Ruiz.
3) Any and all Police Department policies regarding a police officer's requirement to properly identify himself when engaging/investigating a member of the public.
4) Any and all Police Department policies regulating a police officer's conduct when engaging/investigating a member of the public.
5) Any and all documentation initiated or submitted by any agent of Toms River Township, including but not limited to reports, CAD entries, files, photos, videos, emails, etc., in regards to and/or referencing in any way, a "suspicious person" taking photos/video outside the Toms River Police Department & Municipal Court on Friday, January 4, 2019 between the hours of 1030 - 1200 to which Officer Moschella, Sgt. Ruiz, and three additional officers responded.
6) Audio recording of the initial call and/or subsequent calls for the above "suspicious person" as described by Officer Moschella.
7) Any and all radio transmissions in regards to and/or referencing the above described incident.
8) The most recent department-wide training records referencing the Constitutional Rights of citizens and/or how to properly respond to public photography.
9) Any records on file received from the Ocean County Prosecutor's Office regarding the proper response to public photography.
10) Any and all "Use of Force" reports in the last 180 days, submitted by or involving police officer Moschella.
11) Any all "arrest reports" or other documentation in the last 180 days, submitted by or involving police officer Moschella, in regards to and/or referencing charges of "Obstruction", "Hindering", or any other charge brought about due to a suspect or other indiividual's "failure to provide I.D.".
12) Any and all settlement monies paid out by Toms River Township to plaintiffs of police misconduct or wrongdoing since the date of police officer Frank Moschella's hire, whether Moschella was involved or not, including the claim of misconduct or wrongdoing of each case.
