Dear Pompton Lakes Borough,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

1. Appointment & Contractual Records
• The Borough Attorney’s appointment resolution(s) and/or meeting minutes showing appointment or reappointment from 2020 to present.
• The retainer agreement, professional services contract, or any legal services engagement letter between the Borough of Pompton Lakes and the attorney or his law firm from 2020 to present.
• Any Request for Qualifications (RFQ), Request for Proposals (RFP), or bid solicitation documents related to legal services during that same period.
• Any amendments, extensions, or renewals to those agreements.

2. Payment & Billing Records
• All invoices, billing statements, and payment vouchers submitted by the Borough Attorney or his firm from January 1, 2020 to present.
• The corresponding purchase orders, payment authorizations, and check registers showing disbursements made to him or his firm.
• Any reimbursement requests or expense reports submitted by the Borough Attorney.

3. Conflict of Interest & Disclosure Documents
• The Borough Attorney’s financial disclosure statements (FDS) or ethics filings submitted to the Borough or the Local Finance Board from 2020 to present.
• Any conflict of interest forms, certifications, or disclosures on file relating to his representation of Pompton Lakes or other municipalities.

4. Correspondence & Communications
• Any emails or written correspondence between the Borough Attorney (or his law firm) and the Mayor or Council Members from January 1, 2024 to present, concerning public comment policies, Open Public Records Act requests, or advice on constitutional or transparency matters.
• Any legal memoranda or advisories provided by the attorney to the Mayor, Council, or Clerk related to public meeting procedures, citizen identification during meetings, or OPRA exemptions.
(You may redact privileged portions, but please provide all non-privileged portions of such correspondence.)

5. Employment & Background Records
• The attorney’s oath of office and certification of acceptance as Borough Attorney.
• Any resume, biography, or professional qualification documentation submitted to the Borough during his appointment or reappointment.
• Any letters of recommendation, references, or evaluations maintained in Borough records related to his hiring or reappointment.
• Any disciplinary notices, complaints, or claims (internal or external) filed with or received by the Borough regarding his performance or conduct.

6. Insurance & Liability
• Any malpractice insurance certificates or proof of professional liability coverage submitted by the attorney or his firm to the Borough.
• Any notices of claim or litigation in which the Borough Attorney is a named party, representative, or subject of a complaint, from 2020 to present.

The Borough of Pompton Lakes records custodian is in receipt of your Open
Public Records Act (“OPRA”) and common law request submitted on November
12, 2025. The seven-business day deadline to respond to your request is
November 21, 2025. As such, the Borough is timely responding to your
request in accordance with New Jersey law.

 

Please be advised that OPRA allows the records custodian to seek
extensions of time pursuant to N.J.S.A. 47:1A-5i.  In light of the
voluminous nature of your request and the upcoming holidays, the Borough
requires an additional twenty-one business days (until December 26, 2025)
to compile, review/redact, and produce the potentially responsive records
in accordance with New Jersey law. The Borough also reserves the right to
request an additional extension of time if necessary. See Scheeler v. New
Jersey Department of Educ., GRC Complaint No. 2014-123 (2016).
