Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

This timely response denies your OPRA request and requires that you resubmit a valid OPRA request should you wish to continue.
Please be advised that the Township of Hainesport is not in possession of a document containing the items requested. The Township of Hainesport is not required to create a record pursuant to an OPRA request. Sussex Commons Assocs., LLC v. Rutgers Univ., 210 N.J. 531, 544 (2012); see also Burke v. Ocean City., 2013 WL 6169154 (App. Div. 2013) (holding that an OPRA request is not the equivalent of lawsuit discovery). Your request purports to require the Township of Hainesport's records custodian to conduct research from January 1, 2025 to July 22, 2025 to determine whether it has any documents that contain information that is responsive to your OPRA request, which is beyond the obligations of a records custodian. See Lagerkvist v. Office of Governor of State, 443 N.J. Super. 230, 237 (App. Div. 2015) (holding that OPRA does not convert a custodian into a researcher, which would have been the effect of the request).
