Records requested: I am requesting a log of all text messages sent and received from the phone of Council Woman Crowley (732-492-2020) on January 1, 2024 during the time she was present at the reorganization meeting. This phone number is listed on the municipal website and she was witnessed using this device during her time before the meeting began and while the meeting was being conducted. The log should include the date, time and sender (name and phone number) or recipient (name and phone number) of the message.

advised that the phone in question is a personal cell phone; the Borough
does not have access to the phone to create such a log, nor does OPRA
compel an individual to create such a log from a personal device.  See,
e.g. Verry v. Borough of South Bound Brook, GRC Complaint No. 2011-280
(July 2015), where the GRC found that “personal cell phone bills [which
would reflect phone activity involving Borough business] are not
‘government records’ for purposes of OPRA,” and that the New Jersey
Supreme Court’s criteria set forth in Burnett v. County of Bergen, 198
N.J. 408 (2009) militate against disclosure of personal cell phone bills
even if that personal cell phone is utilized for public business.
