The City has reviewed your request and has determined that the
investigation reports you seek are criminal investigatory records that are
exempt from disclosure under OPRA. N.J.S.A. 47:1A-1.1 specifically states
that "a government record shall not include the following information
which is deemed to be confidential for the purposes of P.L.1963, c.73
(C.47:1A-1 et seq.) as amended and supplemented: [...] criminal
investigatory records." N.J.S.A. 47:1A-1.1 defines a criminal
investigatory record as "a record which is not required by law to be made,
maintained or kept on file that is held by a law enforcement agency which
pertains to any criminal investigation or related civil enforcement
proceeding.”

Additionally, all of the records you seek pertain to an ongoing
investigation being conducted in coordination with the Hudson County
Prosecutor's Office.  Disclosure of the records at this time would tend to
jeopardize the investigation, and thus be inimical to the public
interest.   Accordingly, all records requested are denied pursuant to
N.J.S.A. 47:1A-3(a).
 
As to the common law right of access, given the status of the
investigation, the fact that it involves the HCPO, and the fact that it
involves a serious crime, the City's interest in non-disclosure outweighs
your presumed private interest (i.e. - investigation for "restitution of
individuals responsible") at the present time.  

In view of the foregoing, this request is denied and is now being closed.
