Dear Cumberland County Board of Elections,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

A document has been released for record request #26-936
along with the following message:

The County must object to the form of your request, as it
is overbroad. It uses the phraseology “all” without,
specifying which specific vendor or vendors whose invoices
you are seeking. In the case of MAG Entertainment v.
Division of Alcohol and Beverage Control (372 N.J. Super.
534), the Court stated that “[u]nder OPRA, agencies are
required to disclose only ‘identifiable’ government
records not otherwise exempt…In short, OPRA does not
countenance open-ended searches of an agency’s
files.” This request, as worded, is contrary to the
purpose of OPRA and would result in an open ended search
of the County’s records. Kindly clarify your request with
more specificity so that we can identify what documents
are responsive, if any. Further, based on the breadth of
your request, if a clarified request does not provide more
specific or detailed information, we will have to discuss
the imposition of a special service charge and a
reasonable time should be agreed upon to supply a response
(under 47:1A-5 “Whenever the nature, format, manner of
collation, or volume of a government record embodied in
the form of printed matter to be inspected, examined, or
copied pursuant to this section is such that the record
cannot be reproduced by ordinary document copying
equipment in ordinary business size or involves an
extraordinary expenditure of time and effort to
accommodate the request, the public agency may charge, in
addition to the actual cost of duplicating the record, a
special service charge that shall be reasonable and shall
be based upon the actual direct cost of providing the copy
or copies ; provided, however, that in the case of a
municipality, rates for the duplication of particular
records when the actual cost of copying exceeds the
foregoing rates shall be established in advance by
ordinance. The requestor shall have the opportunity to
review and object to the charge prior to it being
incurred.” Emphasis added.)

However, we were able to run a digital search of the
finance program for the phrases “Fire Extinguisher” and
“Fire Alarm” and obtained the attached lists of purchase
orders.  As you will see from the fire extinguisher list,
the expenses were for the purchase of fire extinguishers
as well as inspections, etc.  As to the “fire alarm” list
many of the entries are for fire alarm system phone
lines. 

If you would review the attached and clarify if you are
seeking invoices for purchases of equipment as opposed to
annual inspection fees, etc. and identify the specific
vendor’s whose invoice you are seeking that may eliminate
the need for the imposition of a service charge and may
reduce the amount of time needed to respond to your
voluminous request.
