Dear Mr. Wellington:

 

This correspondence is in response to the two Open Public Records Act
(“OPRA”) requests which you submitted, and which were received by the
District on April 10, 2019. 

 

Those requests read as follows:

 

Request #1

“Total expeditures [sic] and invoices for legal fees associated with the
litigation, consultation and speciliasts [sic] associated with special
education litigation in 2018.”

 

Request #2

 “Total expeditures [sic] and invoices for all legal fees associated with
the litigation, consultation and specialists associated with special
education litigation and legal consultation in 2018.”

 

As an initial matter, given that Request #2 seeks the exact same
information/records, but is worded in slightly more comprehensive fashion,
it appears that Request #2 is a revised version of the immediately
preceding Request #1.  As such, please be advised that unless we receive
further clarification from you, the District will consider Request #1 to
be withdrawn and will only be responding to the revised Request #2. 

 

Please be further advised that the Board is in the process of assembling
and reviewing records to determine what records are responsive to this
request. Once completed, responsive records, redacted as appropriate, will
be provided to you, along with a privilege log which will contain
explanations of what information and/or government records were redacted
and/or not produced pursuant to N.J.S.A. 47:1A-1.1 et seq. and other
relevant legal authority. 

 

Given the significant extent of that review and redaction process, the
Board will need additional time to complete that process.  Moreover, the
District will be closed for Spring Break from April 19, 2019 and will not
reopen until April 29, 2019.  As such, we anticipate having that process
completed by May 3, 2019.

 

If your request for access to a government record has been denied or
unfilled within the seven (7) business days required by law, you have a
right to challenge the decision by the District to deny access.  At your
option, you may either institute a proceeding in the Superior Court of New
Jersey or file a complaint with the Government Records Council (GRC) by
completing the Denial of Access Complaint Form.  You may contact the GRC
by toll-free telephone at 866-850-0511, by mail at P.O. Box 819, Trenton,
NJ 08625, or by e-mail at [1][email address], or at their website at
[2]www.state.nj.us/grc.  The GRC can also answer other questions about the

This correspondence is in follow up our April 11, 2019, correspondence to
you regarding the Open Public Records Act (“OPRA”) requests which you
submitted, and which were received by the District on April 10, 2019. 

 

As you will recall from our initial correspondence, given that your second
request sought the exact same information/records, but was worded in
slightly more comprehensive fashion, the Board indicated that it
considered the first request to be withdrawn unless further clarification
was received from you.  No such clarification was provided, and as such,
the Board hereby responds to the second request, which was worded as
follows:

 

“Total expeditures [sic] and invoices for all legal fees associated with
the litigation, consultation and specialists associated with special
education litigation and legal consultation in 2018.”

 

To the extent that the Board understands this request, attached hereto are
responsive records Bates labelled as TRRS-0001 through TRRS-0124, redacted
as appropriate, along with a redaction log and redaction key which contain
explanations of what information and/or government records were redacted
