Shoprite email records
Dear Piscataway Township,
This is a request for information pursuant to the Open Public Records Act, N.J.S.A. 47:1A-1 et seq., and the common law right of citizens of the state to obtain access to public documents.
This request seeks emails sent from and received by Mayor Brian C. Wahler, and any or all Council members regarding ShopRite of Piscataway's (a brand of Wakefern Food Corp) plans to close its Piscataway location, and any consideration of relocating within Piscataway. Kindly include any personal email correspondence on this matter, including but not limited to messages sent to James Bullard, in his official capacity as a council member, at [email address], Steve Cahn at [email address], Gabrielle Cahill at [email address], Frank Uhrin at frankuhrin@aol.comand any other relevant account that are used by Council members for any Council business.
Although OPRA generally requires a custodian of records to grant or deny a request to access “as soon as possible, but not later than seven business days after receiving the request,” see N.J.S.A. 47:1A-5(i), I understand that you may need additional time to provide the requested records. If so, please contact me before the end of the seven-day period and we can discuss a reasonable response extension. See N.J.S.A. 47:1A-5(g) – (i).
If you determine that any portion of the requested materials is exempt from release, please redact only that which you believe is exempt and provide the remaining, non-exempt portions. See N.J.S.A. 47:1A-5(g). Also, please send us the required index detailing the specific exemptions that justify each redaction or withheld document. See Paff v. N.J. Dep’t of Labor, 392 N.J. Super. 334, 341 (App. Div. 2007).
Please send the records to me as PDF files by email, which is ordinarily free of charge under OPRA. See N.J.S.A. 47:1A-5(b). If you feel that unusual circumstances warrant an additional charge, please advise me of the cost and rationale beforehand so we can discuss.

Good Afternoon,
Your OPRA request requires additional time beyond the seven (7)
business days. OPRA allows custodians to seek extensions of time pursuant
to N.J.S.A. 47:1A-5.i. Specifically, OPRA states that, “the requestor
shall be advised by the custodian when the record can be made available.
If the record is not made available by that time, access shall be deemed
denied.”
Your request requires an extension of time until Friday, December 9th.
