Dear Montclair Township,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.

granting access, denying access, seeking clarification, or requesting an extension of time
within the statutorily mandated seven (7) business days.
Commercial Purpose (exception)
Effective September 3, 2024: If the requestor is seeking records for a “commercial purpose” as
defined in N.J.S.A. 47:1A-1.1, where the response time frame is fourteen (14) business days,
but the custodian shall notify the requestor of the additional time within seven (7) business
days. N.J.S.A. 47:1A-5(i).
Daniel’s Law (exception)
Effective September 3, 2024: If the requestor is seeking records requiring review for
compliance with “Daniel’s Law” (N.J.S.A. 47:1B-1, et seq.), where the response time frame is
fourteen (14) business days, but the custodian shall notify the requestor of the additional
time within seven (7) business days. N.J.S.A. 47:1A-5(i).
As an exception to the typical response time frame, P.L. 2020, c.10, enacted on March 20,
2020, N.J.S.A. 47:1A-5(i) provides that the statutory time frame shall not apply during a
state of emergency, public health emergency, or state of local disaster emergency.

Dear Montclair Township,
Please pass this on to the person who conducts Open Public Records Act reviews.
I am writing to request an internal review of Montclair Township's handling of my OPRA request 'Sgt Davis'.
My request was denied due internal affairs records being exempt from disclosure. While some internal affairs records are exempt, the records I requested are permitted based on the NJ Attorney General Internal Affairs Policy and Procedures (2022).
Specifically, Section 9.6.2 states: (a) The Summary and Conclusions Report described in Section 9.1.1(b) shall be released in response to a request made under the common law right of access by any member of the public or press where it satisfies any of the following conditions:
(1) The Summary and Conclusions Report led to a result on or after January 1, 2023, that requires disclosure pursuant to Section 9.11.2
Section 9.11.2 specifies that agencies must disclose when an agency member was assessed a suspension of more than 5 days, among others.
In my request, Sgt Davis was suspended for 22 days (greater than the 5 day threshold) on or about June 2024 (after the January 1, 2023 threshold).
Therefore, this request for the Summary and Conclusions report shall be provided without delay.
The NJ Attorney General is clear in his directive regarding transparency in Internal Affairs records. If you continue to deny this request, your agency will be subject to scrutiny from the Attorney General’s Office due to failing to comply with their directives and policies.

request is denied under OPRA, thus the 7 day deadline has been met for a
response.
