The City of Salem received your Open Public Records Act (OPRA) request (OPRA REQUEST #2020-10-11) on 1-30-2019. The official Records Custodian, Ben Angeli, RMC, received your OPRA request on 10-22-2020. As such, the seven (7) business day deadline to respond to your request is 11-2-2020. This response to your request is being provided to you on the 2nd business day after the custodian’s receipt of said request.

As per the Attorney handling this matter, the release has not been finalized yet.

Once I receive an executed version, I will forward that to you.

If your request for access to a government record has been denied or unfilled within the seven (7) business days required by law, you have a right to challenge the decision by the City of Salem to deny access. At your option, you may either institute a proceeding in the Superior Court of New Jersey or file a complaint with the Government Records Council (GRC) by completing the Denial of Access Complaint Form. You may contact the GRC by toll-free telephone at 866-850-0511, by mail at P.O. Box 819, Trenton, NJ, 08625, by e-mail at [email address], or at their web site at www.state.nj.us/grc. The GRC can also answer other questions about the law. All questions regarding complaints filed in Superior Court should be directed to the Court Clerk in your County.

Mr. Angeli:

As you will recall, I submitted an OPRA request through the OPRAMachine on or about 10/22/2020 for the Settlement agreement or release that resolved Gross v. City of Salem, Docket No. SLM-L-179-14. I received your 10/26/20 response that said "as per the Attorney handling this matter, the release has not been finalized yet. Once I receive an executed version, I will forward that to you."

Has this happened yet? I would like to get this record immediately.

Mr. Paff,

I received an email from the attorney handling this matter. I copied his response below.

"There is no settlement agreement executed by the plaintiff to date."

Dear Ben Angeli,

Thank you for your diligence. Instead of keeping this request open, let's mark it as being denied because "no responsive record exists." I'll mark my calendar to make another request for the same record in a few months. If you happen to receive the settlement, I'd appreciate it if you'd sent it to me if you happen to remember.

For now, I think it's easiest for both of us if we just close this request.
