Settlement Agreement, Criminal records and Section 10 info (20230519-1)

The request was successful.

Please accept this as my request for government records under both OPRA and the common law right of access. Thank you very much for your commitment to transparent government.

RECORDS REQUESTED:

1. Settlement Agreement or Release that resolved Trayshawn Robinson v. City of Atlantic City et al, Federal Case No 1:20-cv-15281.

2. All CDR-1, CDR-2, Special forms of Complaint or other forms of complaint issued to Trayshawn Robinson that arose out of his encounter with police at the November 2018 event out of which the above cited lawsuit arose.

3. Typically, municipalities do not maintain copies of the dispositions of charges that are filed against citizens by the municipality's police officers. Retaining such records is normally the function of the court. However, in cases where the municipality and its police officers are sued, the attorneys who represent the defendant municipality and the defendant police officers in the civil lawsuit often come into possession of those dispositions through the discovery process or by other means. I request copies of any records that show the disposition of any of the criminal, disorderly persons or other charges that were disclosed in response to No. 2 above. This may require the Clerk's office to reach out to the attorneys who represented the City and its police officers (and the insurance carriers who insured them) to learn if they possess the requested dispositions. See, Burnett v. Gloucester, 415 N.J.Super. 506 (App. Div. 2010).

4. All Use of Force Reports that arose out of Trayshawn Robinson's encounter with police at the November 2018 event out of which the above cited lawsuit arose.

5. For Sean Pettit, his or her "name, title, position, most recent annual salary, length of service, date of separation and the reason therefor." (See N.J.S.A. 47:1A-10).

6. For Kevin Perez, his or her "name, title, position, most recent annual salary, length of service, date of separation and the reason therefor." (See N.J.S.A. 47:1A-10).

7. For Mike Camp, his or her "name, title, position, most recent annual salary, length of service, date of separation and the reason therefor." (See N.J.S.A. 47:1A-10).

8. For Alan Banaga, his or her "name, title, position, most recent annual salary, length of service, date of separation and the reason therefor." (See N.J.S.A. 47:1A-10).

9. For Alex Banaga, his or her "name, title, position, most recent annual salary, length of service, date of separation and the reason therefor." (See N.J.S.A. 47:1A-10).
