RE: PUBLIC RECORDS REQUEST of July 29, 2021, Reference # R003892-072921
Dear Sir/Madam:
This office serves as the custodian of records for the
County of Mercer under the New Jersey Open Public Records Act (OPRA). We
are in receipt of your recent request for government records pertaining to
the above subject. Please accept the following response to same.
Please be advised your request is denied, as it is overbroad and vague.
The County is not required to conduct research, or create records, in
response to an OPRA request. See, MAG Entertainment, LLC, 375 N.J. Super.
534 (App. Div. 2005). OPRA “… is not intended as a research tool… to force
government officials to identify and siphon useful information.”
Lagerkvist v. Office of the Governor, 443 N. J. Super. 203 (App. Div.
2015). In addition, a request for “any” or “all” government records is an
improper request under OPRA. See, Spectraserv, Inc., 416 N.J. Super. 565
(App. Div. 2010).
In addition, please see the County's letter on the GovQA portal for this
OPRA request.
Please call me with any questions. Thank you.
Yours truly,
Paul R. Adezio
Mercer County Counsel
