Dear Brick Township School District,
Please accept this electronic request for public records made under OPRA and the common law right of access. On behalf of Mr. Edwards: Please see the response as follows:
We are in receipt of your OPRA Machine e-mail. Please be advised that as
of September 2024, N.J.S.A. 47:1A-5 requires that a requestor must utilize
the OPRA form adopted by a public entity: "The custodian of a public
agency shall adopt the form established by the Government Records Council
pursuant to subsection b. of section 8 of P.L.2001, c. 404 (C.47:1A-7),
for the use of any person who requests access to a government record held
or controlled by the public agency. The form shall provide space for the
name, address, email address and telephone number of the requestor and a
brief description of the government record sought. A request shall be
submitted by a requestor in the form adopted by the custodian and the
custodian may deny a request that is incomplete, except that a requestor
indicating the request is being submitted anonymously shall not be grounds
for denial." (emphasis added).
However, even if you submit the request via the District's form, the
District does not have a possess any documents that contains the "current
history" of every administrator. When no responsive records exist that are
relevant to a request, a public entity has completed its responsibilities
under OPRA. See Pusterhofer v. N.J. Dep’t of Educ., GRC Complaint No.
2005-49 (July 2005) (finding that a public entity properly denied an OPRA
request despite requestor’s belief additional documentation existed).
The remainder of your request appears to be a request for information.
Under OPRA, almost all requests for information – in and of themselves –
are not permissible. See, e.g., MAG Entm’t, LLC v. Div. of Alcohol
Beverage Control, 375 N.J. Super. 534 (App. Div. 2005) (“While OPRA
provides an alternative means of access to government documents not
otherwise exempted from its reach, it is not intended as a research tool
litigants may use to force government officials to identify and siphon
useful information. Rather, OPRA simply operates to make identifiable
government records readily accessible for inspection, copying, or
examination.”); see also N.J.S.A. 47:1A-1.
That said, OPRA does contain a narrow exception that allows the public to
request information while still being a permissible OPRA request, which
includes the names and titles of employees. See N.J.S.A. 47:1A-10 (an
individual's name, title, position, salary, payroll record, length of
service, date of separation and the reason therefor, and the amount and
type of any pension received shall be considered – in and of itself - a
government record).
If you wish to clarify your request, or simply are seeking the name and
title of each administrator currently employed in the District, please
complete the attached form and send it back to me. Otherwise, this
concludes the District's response to your e-mail.
