This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:
Base salaries and all compensation given for additional titles for all employees including elected officials in the borough for 2018, 2019 and 2020. Including any salary changes and/or raises during those periods.

I received your Open Public Records Act (OPRA) request on February 28,
2020 for "Salaries for all employees including elected officials and all
compensation given for additional titles for all employees for 2018, 2019
and 2020." As such, the seventh (7th) business day deadline to respond to
your request is March 11, 2020. This response to your request is being
provided to you on the seventh (7th) business day after receipt of said
request.
This request requires additional time beyond the seven (7) business days
to fulfill. Currently the borough payroll clerk is aggregating the
information you requested and negotiating the payroll system to accurately
query the information you are requesting. It will take extra time to
properly generate the reports, reconcile for accuracy, and subsequently
forward same. OPRA allows custodians to seek extensions of time pursuant
to N.J.S.A. 47:1A-5.i. Specifically, OPRA states that, "the requestor
shall be advised by the custodian when the record can be made available.
If the record is not made available by that time, access shall be deemed
denied." This request requires an initial extension of time until March
17, 2020.
If your request for access to a government record has been denied or
unfilled within the seven (7) business days required by law, you have a
right to challenge the decision by the Borough of Wallington to deny
access.
At your option, you may either institute a proceeding in the Superior
Court of New Jersey or file a complaint with the Government Records
Council (GRC) by completing the Denial of Access Complaint Form. You may
contact the GRC by toll-free telephone at 866-850-0511, by mail at P.O.
Box 819, Trenton, NJ, 08625, by e-mail at [email address], or at their
web site at www.state.nj.us/grc. The GRC can also answer other questions
about the law.
All questions regarding complaints filed in Superior Court should be
directed to the Court Clerk in your County.

I have not received a follow up analysis from the payroll manager; I will
follow up with him today.

Instructions provided by a requestor have no bearing on our obligation to
fulfill a request in a certain manner. OPRA merely requires to produce
documents which we have, it does not require us to create new documents or
generate them in a preferred form except in rare circumstances. The payroll
manager provided me what he has.
Furthermore, due to the outbreak of COVID-19, Governor Murphy signed into
law A3849 which requires custodians of records to make a ‘reasonable effort’
to comply with OPRA requests within seven (7) business days. However, it
allows a relaxation of the deadlines during this emergency.
This request, 20-038, shall be considered fulfilled.

Dear Greg Zagaja,
While I appreciate your time, you keep delaying the request. The borough must have a salary ordinance and employee agreements to put in the information in their payroll for the year. The information is located in a gross pay register in your payroll system. I am going to keep this OPRA request open until the 2020 Gross Payroll is sent by the Borough. The information is in the borough as all 565 municipalities have it. I am not asking to recreate anything. Every financial or payroll system may call the report a different name but in the end it's all gross salary of what needs to be put in the budget for 2020.
