Dear Roberta Lang,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Resolution No. 23-0805 was an award for a professional services contract with GOVERNMENT STRATEGY GROUP at the Municipal meeting on August 9, 2023. I would like to see the finished product given to Wall Municipal. The taxpayers paid $48,900 for these service/reports and they would be public. I notice the timing is after Kate Kohri's lawsuit was filed against Wall Township Municipal.

Dear Judge Singh:

This firm represents Defendant Wall Township in the above-referenced litigation.
On March 3, 2025, Plaintiff’s counsel sent the undersigned copies of three
subpoenas for the depositions of attorneys who worked for Cleary, Giacobbe,
Alfieri Jacobs LLC, the law firm which represents Wall Township. These three
attorneys participated in the investigation of employment-related claims brought
by Plaintiff Kathleen Khori, then-Assistant Township Administrator, against her
supervisor, Township Administrator Jeffrey Bertrand.

We are writing to request permission to file a Motion for a Protective Order to
prevent these depositions.

"A copy of Cleary Giacobbe’s investigation report was previously provided to
Plaintiff in discovery, and constitutes the best evidence as to this investigation.
Plaintiff has also deposed Sean Kean, Esq., the primary counsel at the Cleary
firm representing Wall Township. Such additional depositions, which are
unilaterally noticed for March 20, 2025, will, by necessity, seek information
protected from disclosure by the attorney-client privilege.

Besides Kean, Plaintiff has already deposed five (5) Township officials and
employees, and has noticed the depositions of two (2) additional Township
employees that will take place this month. Plaintiff was not precluded from
questioning these individuals as to the contents of the investigation report.

Lastly, Plaintiff’s subpoena requests each of these three attorneys to provide
“electronically stored information, or objects, and must permit inspection,
copying, testing, or sampling of the material.” Yet, Plaintiff’s subpoenas are
entirely open-ended and do not specify the information sought. The Court
should not permit the continuation of Plaintiff’s obvious “fishing expedition” in
the vain hope of finding evidence to support her unsubstantiated claims.

For all the above-stated reasons, Defendant requests that the Court either rule
sua sponte that the depositions of these three additional Wall Township
attorneys are prohibited, or, alternatively, allow Defendant the opportunity to file
a Motion for a Protective Order precluding these depositions.
