I am requesting the reason for the rebid for the RFP 24-09 "RFP-Water Treatment Services - Rowan University" that bid on November 7, 2023. Were there any bids received, if yes, could you send me the bid results? Possibly the bids received were overbudget or maybe no bids received at all? Good morning,
Your submission appears to be directed to the inappropriate email as it, in part, is asking questions regarding the status of the bid and/or why there is a rebid. Please be advised that the Open Public Records Act ("OPRA") is a New Jersey statute that governs the public's access to government records in New Jersey. The RFP in question has identified an appropriate email address ([email address]) to submit questions related to the RFP. As a courtesy, I reached out to the department and was advised that there were no eligible proposals submitted for this project. Therefore, a rebid was required.

With regard to your request for the bids, OPRA provides that "[a] government record shall not include the following ... information which, if disclosed, would give an advantage to competitors or bidders." N.J.S.A. 47:1A-1.1. In situations where a requestor seeks access to bids during the selection process, it has been has been determined that same are exempt from disclosure under this exemption. See Renna v. Cnty. of Union, GRC Complaint No. 2003-100 (February 2004), Fisher v. Lakewood Bd. of Educ. (Ocean), GRC Complaint No. 2006-193 (Interim Order dated June 27, 2007), Bond v. Borough
of Washington (Warren), GRC Complaint No. 2009-324 (Final Decision dated March 29, 2011); and Barth vs.Rutgets University, GRC Complaint No. 2017-121 (2017). Based on this, we must deny your request for the bids that were received since the bidding period is open.

I believe this is a full response to your OPRA request and Rowan will close this request unless you advise otherwise.
