No, this is not a new request. I want to know as of the time I made my first request what the results were, and if any contamination was found. I have not modified or changed my request, I merely clarified in case there was any confusion as to what I am seeking. Here is a simple question, was any contamination found in the testing of the ground and or wells? A simple yes or no answer will work.

Dear Jessica Mehl,

I have identified specific records. This is not a legal denial. My request is for the results of any test done at the 17-19 North Main Street property, which I even made more specific by stating I wanted all of the tests for the ground and wells. Your first response claimed that there were no responsive records to my original request, correct? So if that is the case, how does my more specified and limited request now receive a response stating I have not specified the records you previously claimed did not exist? It makes no sense, and it seems you are just trying to confuse and frustrate me. As you know, I use this information to write articles regarding your responses and the information I feel people will find interesting. So for the article I will write regarding whether or not any testing has been done to the property, and if any contamination was found, I will just use your first response to my question. I will let you know though, I have information from a very reliable source who said contamination was found in the wells, I just want the report that shows such so I can properly report on it.

Mr. Duff,

As you can see, Ms. Mehl forwarded your email to me. On August 17th you requested "results of 17-19 North Main Street surveys, including any contaminations found on the site. All reports and results of ground testing for contamination." Ms. Mehl responded to you that there were docs per your request. You then responded with a question, in which she sent you a letter saying you were not requesting a specific government record. You then, sent another email, but have not made a formal OPRA request for any documents that may have been received after your OPRA request dated August 17th.

We will certainly entertain any new OPRA request you may choose to submit. We will not answer questions as part of an OPRA request.

You are greatly confused. The first response I received was that there were "no responsive documents" to my request. You now state "Ms. Mehl responded to you that there were docs per your request", that is not true. You are unlawfully denying my request and again trying to create more confusion and frustration. I am asking one last time to fill this request. You claimed there was no contamination by saying there were no responsive documents, you then said that my request did not specify the records being sought, and you now lie about what transpired in this documented email exchange. I will be going to print later today.
