Resolution/Update to Long-Range Facilities Plan

Response to this request is long overdue. By law, under all circumstances, New Brunswick Board of Education should have responded by now (details). You can complain by requesting an internal review.

Dear New Brunswick Board of Education,

Under OPRA and common law right of access, please provide a copy of the resolution regarding the long-range facilities plan adopted following a "temporary adjournment" of the February 25 board meeting. Please provide a copy of both the sheet of paper Mr. Spencer was reading from, as well as the official resolution signed by President Solis.

Please also provide a copy of the proposed amendment to the long-range facilities plan, if one has been drafted as a result of this resolution.

The official resolution signed is attached with all the other February
approved resolutions.

With regards to the paper Mr. Spencer read from;
Pursuant to P.L 2020, c. 10, during a period declared pursuant to the laws
of this State as a state of emergency, public health emergency, or state of
local disaster emergency the custodian of a government record shall make a
reasonable effort, as the circumstances permit, to respond to a request for
access to a government record within seven business days or as soon as
possible thereafter. OPRA also allows the records custodian to seek
extensions of time pursuant to N.J.S.A. 47:1A-5.-i. Due to the current
disruptions to the District’s operations and closures from coronavirus, the
District anticipates requiring an extension of time until April 30, 2020 to
compile, review, and redact (if necessary) the potentially responsive
records in accordance with New Jersey law. The District also reserves the
right to request an additional extension of time, if necessary. See
Scheeler v. New Jersey Department of Educ., GRC Complaint No. 2014-123
(2016).
