Resolution R-26-172
Dear Howell Township,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
1. all supporting documentation and emails from June 2025 to today concerning R-26-172.
2. All emails and texts between township manager, attorney, governing body member or township employee to or from any employee of Heyer Gruel Associates for the past 12 months.
3. Copy of any proposal received from Heyer Gruel Associates in the past 12 months relating to services to be rendered to Howell Township.
My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.

Please note that your request for emails has been denied. The request requires research rather than identifying specific records. OPRA obligates the custodian to produce identifiable government records; it does not require the custodian to search the agency’s files, analyze their contents, and exercise judgment to determine which records "concern" a given subject. See MAG Entertainment, LLC v. Div. of ABC, 375 N.J. Super. 534 (App. Div. 2005); Bent v. Stafford Police Dep't, 381 N.J. Super. 30 (App. Div. 2005). Moreover, you request for emails does not meet OPRA's specificity requirements for electronic correspondence. OPRA requires that a request for emails identify the specific individuals who sent or received the correspondence, the subject matter, and a time period. Your request does not meet those requirements.
