We're waiting for Lorna Orak to read recent responses and update the status.

Dear New Brunswick City,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

Dear Requestor:

The City of New Brunswick is in receipt of your request assigned number 26-537 in which you
request multiple accident reports for the period of June 26, 2026, to July 5, 2026. A search
revealed [41] responsive accident reports within the time period indicated.

Redactions

Please be advised that motor vehicle accident reports are releasable but will be subject to
redaction pursuant to OPRA, the federal Driver’s Privacy Protection Act (DPPA), and the New
Jersey Driver’s Privacy Protection Act.

In compliance with these laws, the following types of personal information as defined in 18
USC § 2725(3) will be redacted from the records:

• Name
• Driver license numbers
• Address, except 5-digit ZIP
• Telephone numbers
• Medical or disability information

If your request falls under a specific “permissible use” as defined by the DPPA, you may be
entitled to receive the reports with fewer or no redactions. Please complete and return the
attached form if you believe you have a permissible use under the DPPA.

Please note that the US Supreme Court has held that attorney advertising and solicitation is
not a permissible use under the DPPA. Maracich v. Spears, 570 U.S. 48 (2013).

Delivery Method and Cost

           Your OPRA request form indicates a preferred delivery method other than in-person
pickup. Motor vehicle accident reports requested other than in-person are subject to a $5.00
fee per report under N.J.S.A. 39:4-131 and New Brunswick city ordinances. The applicable fee
of $5.00 for each of the [41] reports totals $[205.00], which must be deposited with the City
Clerk before the records are sent.

           Alternatively, you may avoid the delivery fee by picking up the reports in person.
If you indicate this preference, the reports will be provided on a CD and held for pickup at
no additional cost.

If we do not receive payment prior to July 23, 2026, we will assume that you are not
interested in paying the applicable fees and we will consider the OPRA request closed.
