The Township of North Bergen (the “Township”) received your request dated 04/30/2026 under the New Jersey Open Public Records Act (“OPRA”), N.J.S.A. 47:1A-1 et seq.

You requested:

Records requested: Body Worn Camera associated with Case # 25-111646/Officer Jeffrey Santos S40.

Township Response:

Please be advised that N.J.S.A. 47:1A-5(f) requires requestors to certify whether the record(s) sought under OPRA will be used by the requestor or another person for a commercial purpose. “Commercial purpose” is defined as “the direct or indirect use of any part of a government record for . . . any use by which the user expects a profit either through commission, salary, or fee.” Your representation of an insured person is a for-hire commercial purpose. The definition of “commercial purpose” does not exempt OPRA requests made by entities on behalf of for-profit clients.

A requestor who intentionally fails to certify that a request is for a commercial purpose may be fined a civil penalty of $1,000 for the first offense, $2,500 for the second offense, and $5,000 for each subsequent offense (N.J.S.A. 47:1A-11).

N.J.S.A. 47:1A-5 (i) requires a custodian grant access to a government record requested for commercial purposes not later that fourteen (14) business days after receiving the request.

We have made several attempts to contact you and have left multiple voicemail messages at the number you provided, 603-285-4089, in order to deliver the requested body-worn camera footage directly to you electronically. The requested footage was emailed to you directly via AXON link on 5/13/2026 per your initial request.

As with any OPRA request, you have the right to challenge the decision by the Township in regards to your request. At your option, you may either institute a proceeding in the Superior Court of New Jersey or file a complaint with the Government Records Council (“GRC”) by completing the Denial of Access Complaint Form. You may contact the GRC by toll-free telephone at 866-850-0511, by mail at PO Box 819, Trenton, NJ 08625, by e-mail at [email address] or at their web site at https://www.nj.gov/grc. The GRC can also answer other questions about the law. All questions regarding complaints filed in Superior Court should be directed to the Court Clerk in the County in which you reside.
