With respect to the "and correspondence relating thereto" portion of the request, as a threshold matter, is invalid because it fails to identify with reasonable clarity the specific government records sought. See Murphy v. N.J. Dept. of Corrections, GRC Complaint No. 2015-340. The request may not be a description of information that requires the custodian to search the agency’s files and “analyze, compile and collate” the requested information. Id. See also MAG Entm’t, LLC v. Div. of Alcoholic Beverage Control, 375 N.J. Super. 534, 549 (App. Div. 2005). Moreover, the law is clear that “OPRA does not countenance open-ended searches of an agency’s files.” MAG Entertainment, LLC v. Div. of ABC, 375 N.J. Super. 534, 549 (App. Div. 2005). Because your request for all records is overly broad and fails to identify specific government records sought, your request is invalid under OPRA. MAG Entertainment, LLC v. Division of Alcoholic Beverage Control, 375 N.J. Super. 534 (App. Div. 2005), Bent v. Stafford Police Department, 381 N.J. Super. 30 (App. Div. 2005), New Jersey Builders Association v. New Jersey Council of Affordable Housing, 390 N.J. Super. 166 (App. Div. 2007) and Schuler v. Borough of Bloomsbury, GRC Complaint No. 2007-151 (February 2009).
In the event of a clarification or appeal, Township reserves the right to raise any other ground for denial not raised in this response. The failure of Township to assert an exception or privilege at this time does not act as a waiver of any grounds for denial. Thank you for your professional courtesies and attention to this matter.
