Dear Caldwell Borough,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
Pursuant to N.J.S.A. 47:1A-1 et seq., I request access to all administrative records maintained by the Caldwell Police Department from January 1, 2023 through the present that document the return, release, transfer, destruction, or other disposition of firearms.
This includes, but is not limited to:
• Property release forms,
• Firearm return receipts,
• Disposition logs or destruction authorizations,
• Chain-of-custody updates,
• Any inter-agency communications reflecting firearm return or release to individuals.
This request does not include:
• Firearm permit applications or licensing records governed by N.J.S.A. 2C:58-3(f),
• Narrative criminal or investigatory reports under N.J.S.A. 47:1A-3,
• Internal strategy documents or protected personal identifiers.
This request is limited to non-investigative administrative records maintained in the regular course of business.
If any portion of this request is withheld, I respectfully request:
• Confirmation of whether responsive records exist,
• Identification of the record(s) being withheld,
• Citation of the specific statutory exemption being relied upon, and
• Release of all non-exempt portions in redacted form, pursuant to N.J.S.A. 47:1A-5.
If no responsive records exist, I request confirmation of that fact in writing.
