Dear Irvington Township,
This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:
1. A list of all lands for which a zoning adjustment has been proposed between August 24, 2023 and August 24, 2024. Please include filing date, and description of the proposed use. Please provide this list in an excel document separate from the forthcoming items.
2. A list of all new construction (ground up) permits issued since January 2023.
2. A list of all Vacant land (property class 1), which have had the same owners/ title holders for more than 10 years. Please include address, owner name, and size of land. Please provide this list in an excel document separate from the forthcoming items.
3. A list of all residential (property class 2) and commercial (property
classes 4A & 4C) properties that have code violations, water shut offs, have undergone fire damage and are deemed vacant or abandoned. This list should be since July 1st, 2024. Please provide filing date, type of violation (where applicable), and owner name. Please provide this list in an excel document separate from the forthcoming items.
4. A list of all surplus real estate in the possession of the city. Please provide this list in an excel document separate from the aforementioned items.

Section 40:48-2.12s3 - Municipal ordinances, authority; foreclosed, abandoned properties; filing summons, complaints, there is no list your municipality has tracked and/or can make readily available to the public .

This information, by law should be tracked and made readily available to the public. Your offices have initially stated my request was rejected (not providing a legal basis for same). Now you are indicating this information is not tracked, placing your township in contravention/violation of the aforementioned law.
Please provide your position for the general public, as (in my opinion) what is being communicated is that your township refuses to abide by legislation.

Dear Township of Irvington NJ Public Records,
I have been in contact with Mr. Williams, who as I understand per my conversation is responsible for delegation of OPRA requests.
During my phone call with Mr. Williams at 12:34 PM of this date, with a duration of 14 minutes- Mr. Williams indicated to me that he will not facilitate documentation as wording in my request was too specific. At this point, I requested from Mr. Williams that he send me documentation corresponding to vacant properties which appears to be the only list (he insinuates) the city keeps and which he agreed to comply with.
As indicated to Mr. Williams, this request has been made to other municipalities which, although they may not have documentation filtered to the tee (the way the requestor is looking for), have at minimum worked to facilitate documentation per legislation. Mr. Williams has undoubtedly made all efforts to not facilitate documentation. This conduct is unbecoming of a public official, yet alone a director of a department.
To avoid misinterpretation; Mr. Williams, et. Al, please facilitate documentation of any and all vacant property records in possession of the municipality of Livingston with the dates in the original request.
Denial or refusal of response to this request, will provoke escalation of this matter as the public is entitled to access and review of said information . Applicable laws have been cited both in writing and verbally to you and your department.
