Dear South Toms River Borough,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

In reference to your OPRA request for the Body Worn Camera of officer
Dominick Palino #29-316 Arrest of Dorian Antiono Tyler, the police
department requires a date when the incident took place.  
If you are entitled to view the records please note that the borough has a
$15 per hour special service fee for requests that involve extraordinary
time and/or effort to comply with the request submitted.  The ploice
department will determine if that is the case with your request. Half of
the fee would be due before beginning your request and then the other half
due before the information will be released to you.

Dear Thea Kratochvil,

In that case, I intend to file a General Records Complaint against the Borough, which will cost the town more money than it would make from a special service fee. The town will be responsible for paying for my counsel; furthermore, it will tie up the staff, in court costs and resources.
