Dear Toms River School District,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.

Pursuant to the New Jersey Open Public Records Act (N.J.S.A. 47:1A-1 et seq.), I hereby request access to and copies of all records maintained by the school district concerning my child listed above.
This request includes, but is not limited to, the following:
1. Complete Student Record / Cumulative File

•Contact information forms
•Emergency contact sheets
•Health records
•Disciplinary records
•Academic records
•Special services or evaluations (if any)
•Any and all documents permitted to parents under N.J.A.C. 6A:32-7.1 et seq.
2. Full Attendance Records
•Daily attendance (all dates of enrollment 2020-2025)
•Tardy and early dismissal records
•Absence documentation or notes received
•Any internal attendance logs or electronic reports
3. Any and All Records Related to Welfare Checks, Safety Concerns, or Mandatory Reports
• I specifically request all documentation created by any staff member, administrator, counselor, nurse, or school employee relating to:
•Any welfare checks initiated or requested
•Any calls, referrals, or reports made to DCPP (formerly DYFS)
•Any calls, referrals, or reports made to local police regarding my child or household
•Dates and times of any such calls
•Written narratives, incident reports, emails, memos, or internal notes
•Identity or title of the staff member(s) making the report (to the extent allowed under law)
•Any follow-up communications, determinations, or outcomes if provided back to the school
•Copies of any written notices sent to parents regarding such reports
•Any “concerns,” “flags,” or safety-related files created by the school
4. Communications
•All communications to or from school staff regarding any attendance concern, welfare concern, police involvement, or DCPP involvement, including:
•Emails
•Letters
•Internal notes
•Text messages (if kept)
•Parent communication logs
•Teacher or staff narrative notes
•Format and Delivery
Please include full and current active copy of toms river board of education specifically Joseph Citta Elementary schools protocols and procedures so we may compare what rules and regs are and what was actually ignored, done or ignored in reality.
Please provide all records in electronic format (PDF or native format) via email or through OPRAmachine. If any portion of this request is denied, please provide the legal basis for each denial as required under N.J.S.A. 47:1A-5(g).

The Toms River Regional School District ("District") received your "Open
Public Records Act" (OPRA) request dated today, Wednesday, May 20, 2026.
The official Custodian of Records received your "OPRA" request today, on
May 20, 2026. Please be advised that student records you are seeking
pertain to your own child, the request falls under the federal Family
Educational Rights and Privacy Act (FERPA), rather than the New Jersey
Open Public Records Act (OPRA).
(FERPA requests as if the documents exist they would be considered
educational records) Records responsive to this item exist but are denied
in full to the extent they constitute student records under the New Jersey
Pupil Records Act, N.J.S.A. 18A:36-19, and N.J.A.C. 6A:32-7.1 et seq., and
are further protected from disclosure under FERPA, 20 U.S.C. § 1232g. OPRA
expressly exempts records the disclosure of which is restricted by other
state or federal law. See N.J.S.A. 47:1A-9. Records concerning an
identifiable student are accessible to the parent through the District's
student records procedure, not through OPRA. OPRA requires the production
of government records; it does not require an agency to answer questions,
conduct research, or provide narrative responses. Bart v. City of Paterson
Hous. Auth., 403 N.J. Super. 609 (App. Div. 2008).
