Dear Seaside Heights Borough,

Please accept this electronic request for public records made under the New Jersey Open Public Records Act (OPRA) and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request, as per N.J.S.A. 47:1A-5(f), which states that a written request including all the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Pursuant to OPRA and the common law right of access, I hereby request the following aggregated records from the Seaside Heights Police Department for the period from December 1, 2024 to Present:
1. The total number of full-time law enforcement officers tested for drug use.
2. The total number of Special Law Enforcement Officer Class I (SLEO I) personnel tested for drug use.
3. For full-time officers:
• The number who tested positive, specifying the substance detected (e.g., marijuana, cocaine, etc.).
• The outcome for each officer who tested positive (e.g., termination, suspension, etc.).
4. For SLEO I personnel:
• The number who tested positive, specifying the substance detected.
• The outcome for each SLEO I who tested positive.

I understand that individual identities are protected under OPRA’s exemptions; therefore, I am requesting only aggregated data without any personal identifiers. If these records exist in electronic format, please provide them via the OPRAmachine platform. Should there be any issues with this platform, please contact me through OPRAmachine for alternative arrangements.

Should any portion of this request be denied or withheld under a claim of exemption, please provide the legal basis for such denial and identify the specific records being withheld, as required under OPRA.
