Dear Nutley Township,
I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request. I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States. I WILL NOT use the requested government records for a commercial purpose. I AM seeking records in connection with a legal proceeding.

Pursuant to the New Jersey Open Public Records Act (N.J.S.A. 47:1A-1 et seq.), I hereby request copies of the following government records related to myself and the associated incidents and officers.
I request all records for the period of June 1, 2025, to the present. If any record is being withheld, please provide a specific legal justification for the denial pursuant to N.J.S.A. 47:1A-5(g).
I. BODY-WORN CAMERA (BWC) AND IN-CAR CAMERA (ICC) FOOTAGE
Please provide all unedited BWC and ICC footage for all officers present at the following incidents:
INCIDENT 1 (June 20, 2025): The arrest and search of Kyle Feggins.
Police Cruiser dash cam footage of P/O Struss vehicle 6/20/25
Police Cruiser dash cam footage of Det Argentieri 6/20/25
Body Camera Footage of Captain Fromaggio body came footage 6/20/25
Officers: Detective Dominic Argentieri, and any assisting officers.
Description: Footage must include the full duration of the search and transport.
INCIDENT 2 (November 5, 2025): Medical/Narcotics Call at 64 Edgar Place.
Officers: Patrolman Richard Rempusheski, Sergeant Lopez (Badge #364), and any assisting officers who entered the residence or interacted with witnesses.
Description: Footage must include the initial entry, interaction with Roberto Lascano, Valerie Demoleas, and Aimee Lorenzo, the search of the premises, and the lack of administering Narcan.
II. POLICE REPORTS, SUPPLEMENTARY REPORTS, AND CRIMINAL FILE DOCUMENTS
Please provide all documents (including CAD logs, dispatch recordings, preliminary reports, supplementary reports, evidence logs, witness statements, and narrative reports) associated with:
Incident #1 (June 20, 2025): All reports related to the initial arrest of Kyle Feggins.
Warrant W 2025 212: All supporting documents, affidavits, and police narratives related to the arrest warrant issued on or about November 5, 2025 (CDS/Paraphernalia).
Warrant W 2025 222: All supporting documents, affidavits, statements of probable cause, and the underlying sworn complaint (authored by Det. Argentieri) related to the arrest warrant issued on or about November 19, 2025 (Theft/Fraud).
Witness Richard Klim: All documents, interview notes, and recording transcripts related to the statement provided by Richard Klim concerning the credit card theft allegation.
Witness Roberto Lascano: All documents, interview notes, and evidence logs related to the November 5, 2025 incident, specifically including all inventory logs for evidence seized at 64 Edgar Place.
III. INTERNAL AFFAIRS (IA) RECORDS AND COMMUNICATIONS
Please provide all non-confidential records related to the following Internal Affairs cases filed by Kyle E. Feggins. As the Complainant, I am entitled to documentation showing the status and outcome of these investigations:
IA Case #25-13 (Filed June 2025 - Allegations against Det. Dominic Argentieri).
Specifically: All investigation summaries, final disposition letters, and any communication between NPD IA and the Essex County Prosecutor’s Office (ECPO) regarding this case.
IA Case #25-14 (Filed August 2025).
IA Case #25-23 (Filed October 2025).
IA Case #25-30 (Filed November 2025 - Allegations against D/Lt. Eric Stabinski).
All written communications (emails/memos) between any member of the Nutley Police Department and the Essex County Prosecutor’s Office Professional Standards Bureau concerning the sexual assault allegation (IA Case #25-13) and the subsequent warrants (W 2025 212 & W 2025 222).

This correspondence shall serve as Nutley Township (the “Township”)’s
response to your request for access to government records pursuant to the
Open Public Records Act, N.J.S.A. 47:1A-1.1, et seq. (“OPRA”), which was
received by the Township on November 28, 2025 during regular office hours.
Attached is a copy of your request for records, and below is the
Township’s response to the same:
Upon additional review of your two (2) submitted requests by the OPRA team
and OPRA legal counsel, it has been determined that the substantive
requests are identical. Therefore, this request is superceded by your
second request (RR # 715-25), and will be closed.
As for your other request RR # 715-25, please expect a response shortly.
To the extent that you have also requested access to the above government
records under the common law, your stated interest in obtaining the
records must be balanced against the Township of Nutley’s interest in
nondisclosure. See Loigman v. Kimmelman, 102 N.J. 98 (1986). The foregoing
response to your request for access to government records incorporates the
aforementioned balancing test. Please note that "a party's status as a
litigant does not enlarge its access to government records under OPRA”.
MAG Entm't, LLC v. Div. of Alcoholic Beverage Control, 375 N.J. Super.
534, 545-46 (App. Div. 2005). The Township reserves its right to deny any
request for records that are the subject of any discovery, subpoena or
court order pursuant to N.J.S.A. 47:1A-5. Moreover, the Township may
restrict access to records sought for a commercial purpose. Id. The
Township reserves the right to raise any other grounds for denial not
raised in this response. Failure of the Township to assert an exemption or
privilege does not act as a waiver of any grounds for denial. Furthermore,
a reviewing Court or the Government Records Council ("GRC") may deem a
denial of access to be authorized on grounds other that those advanced by
a custodian. See Paff v. Twp. of Plainsboro, A-2122- 05T2, 2007 WL 957289,
at *2 (App. Div., Apr. 2, 2007), affirming, Paff v. Township of
Plainsboro, GRC Complaint No. 2005-29 (March 2006). If your request for
access to a government record has been denied or unfilled, you have a
right to challenge the decision by the Township to deny access. At your
option, you may either initiate a proceeding in the Superior Court of New
Jersey or file a complaint with the GRC by completing the Denial of Access
Complaint Form. You may contact the GRC by toll-free telephone at
866-850-0511, by mail at P.O. Box 819, Trenton, NJ, 08625, by e-mail at

GRC can also answer other questions about the law. All questions regarding
