Under the NJ Open Public Records Act (N.J.S.A. 47:1A-1 et seq.),
I hereby request access to and copies of the following government records regarding the police response to my home at 502 Rio Grande Drive in Toms River NJ 08755 on 11/23/2026;
1.) Audio & Video Footage: All Body-Worn Camera (BWC) & Dashboard Camera (Dashcam) footage captured by any & all responding officers, supervisors, or personnel present at the scene between the hours of 12:00 pm & 9:00 pm. Multiple attempts were made on same day & sam officers even escorted DCPP later that evening back to my home AGAIN. We request all recordings for that day to taken on way to or leaving our home & ofc at or around our home.
2.) Dispatch & Logs: The complete Computer-Aided Dispatch (CAD) log, dispatch audio recordings, 911 call audio recordings & radio transmissions related to the dispatch & response.
3.)Mobile & Written Communications: To the extent that dept-issued/ personal cell phones if utilized to conduct official public business regarding this incident, I request all text msgs, SMS, logs, or mobile app communications exchanged bw responding officers, supervisors & dispatch.
4.)The Initiating Referral: Any 911 calls, phone audio, intake sheets, electronic transmissions, or emails received from personnel at Joseph A. Citta Elementary School or the Toms River Regional School District requesting or initiating the welfare check(s) on my son, Anthony Guzman Jr. 5. Reports: All Police Incident Reports, Investigative Reports, Supplemental Reports, Use of Force Reports & Supervisor Review Reports generated in connection with/re this incident.
Supporting Case Law:
• Juvenile Records Exception Misapplication: N.J.S.A. 2A:4A-60 protects juvenile delinquency records from public disclosure. It doesnt apply to a standard wellness check/school initiated safety referral. As the legal parent & guardian of Anthony Guzman Jr., I maintain an absolute right of access to records concerning my minor child.
• Cell Phone Communications as Public Records: Under NJ GRC guidance & City of San Jose v. Superior Court, communications regarding official government business are public records subject to OPRA, regardless of whether they occurred on a police radio or a cell phone.
• Privacy Balance: Pursuant to Brennan v. Bergen County Prosecutor's Office, any privacy concerns regarding video inside a home must be satisfied by redacting/blurring non-essential private imagery, rather than withholding the record entirely.
If my request is denied or redacted in part, please provide a specific, detailed statutory justification for each line item as required by N.J.S.A. 47:1A-5(g).I maintain my right to appeal any denial w/in the statutory 45-day deadline to the Government Records Council (GRC) or via NJ Superior Court.
