This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:
I'm requesting an alleged victim's Probable Cause statement from 12/10/19 that was written on or before 3:30 PM at the Mahwah Police Station describing how they alleged they were assaulted by a Manager with the initials M.F. on 12/9/19 at their work location located at 320 NJ-17, Mahwah, NJ 07430.
Lastly, I'm requesting the alleged victim's signed criminal complaint and all documents related to that case.

Attached are documents in reference to your OPRA Request regarding a
December 9, 2019 incident. For your information, the individual never
returned to the Police Department and therefore there is no probable cause
statement or other records.

As stated before, the victim filed a Probable Cause Statement during their first visit to the Mahwah Police station.
Since you claim the Probable Cause Statement does not exist.
I will accept your statement as a denial of records and proceed with a complaint with the GRC with supporting evidence that the Probable Cause Statement does exist.

Mr. Capers - As a follow-up to your email below, the Police Department again searched for a responsive probable cause statement and located no responsive records in Police Department files. Be aware that a probable cause statement and civilian complaint could have been filed directly with the Mahwah Court and not through the Police Department. If that were the case, you would need to contact the Municipal Court directly for records.
