Request for Open Code Violations – 06/01/2025to 09/01/2025 – Property Maintenance, Structural, Grass, Weeds, Lead Hazards (Excel Format)
Dear Mendham Township,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
Active Code Violation List Request for 06/01/2025to 09/01/2025. I kindly request a list of all UNRESOLVED or OPEN code violations (please do not include closed violations) for all properties in the city during this time period, specifically related to property maintenance, structural issues, and weeds, tall grass, water shutoffs, Mold/Mildew. Please include descriptions of the violations, property addresses, and violation dates, homeowner's name. I also prefer for the document to be sent here in OPRA, not in my email (sometimes it does not appear in my inbox).
Please provide these requests in excel or google sheets format, documents must be in format requested per OPRA
Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.

Dear Mendham Township,
I am following up on my OPRA request submitted on September 2, 2025, regarding a list of all unresolved or open code violations (06/01/2025 – 09/01/2025). I have not yet received an acknowledgement or response.
Pursuant to N.J.S.A. 47:1A-5(i), a custodian is required to respond to an OPRA request within seven (7) business days. Could you please confirm receipt of my request and advise on its status?

Mr. Aguilon,
On September 11, 2025, the Township provided you with documents responsive
to part of your September 2, 2025 request, in the format you specified,
and within the timeframe required under the Open Public Records Act
(N.J.S.A. 47:1A-1 et seq.). The Township also requested additional time
(on or before September 18th) to review and respond to the remaining
portion of your request for “Open Code Violations – 06/01/2025 to
09/01/2025 – Property Maintenance, Structural, Grass, Weeds, Lead Hazards
(Excel Format).”
Regarding the remaining portion of your request, the Township does not
possess any responsive records, with the exception of open code violations
related to lead hazards during the specified time period. These violations
were specifically issued pursuant to N.J.A.C. 8:51-4.1, which addresses
environmental intervention for children with confirmed blood lead levels
of five micrograms per deciliter (g/dL) or higher. However, this
information is confidential and protected under N.J.A.C. 8:51-3.3.
Accordingly, your OPRA request for open “lead hazard” code
violations for the period of June 1, 2025, to September 1, 2025, is
denied, pursuant to the above-cited regulation, which prohibits disclosure
due to confidentiality requirements.
Please confirm receipt of my email from September 11, 2025 which contained
responsive records and confirm receipt of todays email.
