Dear Chatham Township,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

Active Code Violation List Request for 05/28/2025 to 08/28/2025. I kindly request a list of all UNRESOLVED or OPEN code violations (please do not include closed violations) for all properties in the city during this time period, specifically related to property maintenance, structural issues, and weeds, tall grass, water shutoffs, Mold/Mildew. Please include descriptions of the violations, property addresses, and violation dates, homeowner's name. I also prefer for the document to be sent here in OPRA, not in my email (sometimes it does not appear in my inbox).

Please provide these requests in excel or google sheets format, documents must be in format requested per OPRA

Dear Christine Morgan,

Thank you for your response to my OPRA request and for providing the file. However, the records were sent in PDF format, which is contrary to the format I specifically requested.

Per N.J.S.A. 47:1A-5(d), “A custodian shall permit access to a government record and provide a copy of such record in the medium requested if the public agency maintains the record in that medium.” Since the requested records are clearly maintained in a database or electronic format, they must be provided in the format I requested—Excel or Google Sheets.

I must respectfully insist that my OPRA request be fulfilled in compliance with the statute. Please resend the Active Code Violation List (05/28/2025 – 08/28/2025) in Excel or Google Sheets format, as originally requested.

Kindly confirm once the corrected file has been provided.

Dear Gregory Laconte,

Thank you for providing the file in response to my OPRA request. However, I noticed that the file is an Excel document containing an image of the records, rather than the data being entered into structured cells and rows.

As per my original request, I kindly ask that the information be provided in a usable Excel or Google Sheets format, with the entries properly arranged in rows and columns to allow for sorting and filtering.

Please let me know if you need any clarification on the formatting. I appreciate your assistance and look forward to receiving the corrected file.

Dear Gregory Laconte,

Thank you for sending the file in Excel format. However, the document appears to contain images embedded within the spreadsheet, which makes it not possible to sort, filter, or search the information.

Since OPRA requires records to be provided in the medium requested if they are maintained in that medium, may I kindly request that the file be provided in a true Excel format with the data in sortable cells/columns, rather than as images?

If the Borough’s system does not allow export to Excel, I am happy to receive the file in any machine-readable format (CSV, text, or similar) that would allow sorting and filtering.
