Request for Open Code Violations – 05/28/2025 to 08/28/2025 – Property Maintenance, Structural, Grass, Weeds, Lead Hazards (Excel Format)
Dear South Brunswick Township,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
Active Code Violation List Request for 05/28/2025 to 08/28/2025. I kindly request a list of all UNRESOLVED or OPEN code violations (please do not include closed violations) for all properties in the city during this time period, specifically related to property maintenance, structural issues, and weeds, tall grass, water shutoffs, Mold/Mildew. Please include descriptions of the violations, property addresses, and violation dates, homeowner's name. I also prefer for the document to be sent here in OPRA, not in my email (sometimes it does not appear in my inbox).
Please provide these requests in excel or google sheets format, documents must be in format requested per OPRA
Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.

Be advised under N.J.S.A 47:1A-1.et.seq., "The custodian of a public
agency shall adopt the form established by the Government Records Council
pursuant to subsection b. of section 8 of P.L.2001, c.404 (C.47:1A-7), for
the use of any person who requests access to a government record held or
controlled by the public agency. The form shall provide space for the
name, address, email address and telephone number of the requestor and a
brief description of the government record sought. A request shall be
submitted by a requestor in the form adopted by the custodian and the
custodian may deny a request that is incomplete, … A completed form
adopted by the custodian, a letter, or an email from a requestor including
all of the information required on the adopted form shall suffice in place
of a completed form as a valid government record request. … If a letter or
an email from a requestor does not include all of the information required
on the adopted form, the custodian may deny the record request… The form
also shall include space for a requestor to certify whether the government
record will be used by that requestor or another person for a commercial
purpose, and the requestor shall be required to provide this information
for the request to be fulfilled … The requestor shall be required to
certify whether the government record is being sought in connection with a
legal proceeding and identify the proceeding for the request to be
fulfilled."

Thank you for your response. I must respectfully clarify my rights under the Open Public Records Act (OPRA), N.J.S.A. 47:1A-1 et seq.
As you correctly cited, N.J.S.A. 47:1A-5(f) provides that:
“A completed form adopted by the custodian, a letter, or an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.”
However, OPRA further allows that a request may be made anonymously. A requestor is not required to disclose their mailing address, email address, or telephone number in order for a request to be valid. The statute requires only that the request include a sufficiently clear description of the records sought and the required certifications regarding commercial use and legal proceedings.
For clarity:
I am exercising my right under OPRA to submit this request anonymously.
Delivery of the requested records may be made by uploading them directly to this OPRA portal (not via email attachments, which are frequently blocked).
As reiterated in my original request, I am seeking:
A list of all unresolved/open code violations between 05/28/2025 and 08/28/2025,
Including property address, violation description, violation date, and homeowner’s name,
Specifically covering property maintenance, structural issues, weeds/tall grass, water shutoffs, and mold/mildew,
Provided in Excel or Google Sheets format, as OPRA requires records be provided “in the medium requested if the agency maintains the record in that medium” (N.J.S.A. 47:1A-5(d)).
My request includes all mandatory OPRA certifications and satisfies the statutory requirements for a valid request. Please confirm this request is being processed accordingly.

In regards to the email you sent on Saturday while we were closed, yes
there are only two. In regards to the email you sent Monday while we were
still closed, that request is too broad if you are looking for codes you
can find that information on the state DCA website.

Thank you for your response and for providing the property maintenance violation records for South Brunswick.
First, a small correction — my name is Mr. Aguilon.
Second, while I appreciate the documents provided, they were sent in PDF format. As stated in my initial request, I specifically requested the records in Excel (or Google Sheets/CSV) format.
Pursuant to N.J.S.A. 47:1A-5(d), when a requestor specifies the medium in which a record is sought, the custodian must provide it in that medium if the agency maintains the record in that format or it is readily convertible. Since these records are clearly maintained in an electronic format, they can and should be provided in Excel/CSV.
I respectfully request that the records be re-issued in Excel format to comply with OPRA.
