Request for Open Code Violations – 07/30/2025 to 08/11/2025 – Property Maintenance, Structural, Grass, Weeds, Lead Hazards

Dear Carteret Borough,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL use the requested government records for a commercial purpose. (Real Estate)

I AM NOT seeking records in connection with a legal proceeding.

Records requested: Code Violation List Request for 07/30/2025 to 08/11/2025. I kindly request a list of all UNRESOLVED or OPEN code violations (please do not include closed violations) for all properties in the city during this time period, specifically related to property maintenance, structural issues, tall grass, lead hazard, and weeds. Please include descriptions of the violations, property addresses, and violation dates. I also prefer for the document to be sent here in OPRA not in my email (sometimes it does not appear in my inbox) and I am specifically requesting that the data be provided in Excel spreadsheet format (.xlsx). Thank you so much.

My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.

Dear Clerk Office,

I am confused. If the borough does not keep a list of code violations, then please review any code violations that have been filled by the borough of Carteret against any properties, aggregate that data for open violations and provide that document, based on the initial requirements.

I understand the 'list of code violations' may not exist as a record, but there are some data on code violations that have filled against property owners - whether those records exist as one list, or several property addresses.

To clarify, I am seeking ALL code violation records (not the list itself, but each individual record of code violations). Please provide that data, following the requirements we had mentioned in the indivdual request.

If you do not have these records, then please confirm that NO code violations have been issued in the borough of carteret, whatsoever

Dear Clerk Office,

Thank you for your reply. For clarity, I want to confirm your prior response:

Are you stating that the Borough of Carteret does not maintain any records of code violations (open or unresolved) for the period I requested?

Or are you confirming that no code violations of any kind were issued during the requested timeframe?

Since OPRA requires that requests be responded to within seven business days, I kindly ask for a direct confirmation to ensure the record is clear. If responsive records exist, even if not in the form of a single list, please provide the individual violation records in Excel format, as originally requested.

No, what I am saying is the Borough does not maintain a "list" of properties with open code violations. That would require me to "make" a record and I am not required to do so under OPRA.
