Dear East Brunswick Police Department,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per N.J.S.A. 47:1A-5(f), which states that an email from a requestor containing all required information shall suffice as a valid records request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with any legal proceeding.

I request copies of all OPRA requests received by your agency from January 1, 2025, to the present that sought Body-Worn Camera (BWC) or Motor Vehicle Camera (MVC) footage. I also request copies of the BWC or MVC videos that were already located, reviewed, and released in response to those prior OPRA requests.

To minimize agency workload, I clarify that I am not requesting the identification or search of any new incidents or any new footage. I am requesting only materials that already exist, that have already been gathered and reviewed, and that have already been released to previous requestors. I will accept all records in whatever digital format they currently exist.

These records are disclosable government records under OPRA. Prior OPRA requests and any responsive footage that has already been released are public records, and previously disclosed BWC or MVC footage cannot later be withheld under investigatory exemptions. Because these items have already undergone legal review, producing them again does not require new exemption analysis, redaction, or investigation.

Greetings,

This is in response to your Open Public Records Act (OPRA)
request for access to East Brunswick Police Department Records.

Your OPRA request sought access to the following records:

“I request copies of all OPRA requests received by your agency
from January 1, 2025, to the present that sought Body-Worn
Camera (BWC) or Motor Vehicle Camera (MVC) footage. I also
request copies of the BWC or MVC videos that were already
located, reviewed, and released in response to those prior OPRA
requests.

To minimize agency workload, I clarify that I am not requesting

Response: At the outset, you should be aware that we are unable
to search and filter our portal database solely by the type of
record(s) requested. Due to limitations in the database, we are
unable to provide a copy of each OPRA request, as it would
require a custodian to search a wide range of records and
analyze which records are related to your request. More
specifically, the custodian would be required to read and review
every OPRA request in the system for 2025, determine whether
“Body-Worn Camera (BWC) or Motor Vehicle Camera (MVC) footage”
was requested, determine whether the requested records were
granted, and determine whether the records are still available.
This type of records research is not required, and the request
is therefore overly broad (See Burnett, 415 N.J. Super. at
515-16). Therefore, requests can be denied that would require
the custodian "to manually search through all of the agency's
files, analyze, compile and collate the information contained
therein" (Id. at 549; see also Bart v. Passaic County Public
Hous. Agency, 406 N.J. Super. 445, 451 (App. Div. 2009).

However, a defined database query was conducted using the
provided search parameters. An export of each of those search
results is being provided in its entirety. If you would like an
export of each specific OPRA request resulting from the search,
a special service charge may be imposed, as it would require
additional time beyond what is necessary to process an OPRA
request. Once a response is received indicating that you are
willing to pay a special service charge, we can provide an exact
calculation of the charges.

Finally, you should be advised that this agency does not
maintain a mobile video camera system in its patrol vehicles.
Additionally, you should be aware that retention times may have
rendered the requested records unavailable. Should you desire,
we invite you to narrow your request in accordance with OPRA in
a new request.

The East Brunswick Police Department reserves the right to raise
any other grounds in support of this response. The failure of
the East Brunswick Police Department to assert any exception,
exemption, or privilege does not act as a waiver of any ground
for denial.
