The Department of Education is in receipt of your request below. Pursuant to Burke v. Brandes, 429 N.J. Super 169 (App. Div. 2012); MAG Entertainment, LLC v. Division of Alcoholic Beverage Control, 375 N.J. Super. 534 (App. Div. 2005); Bent v. Stafford Police Department, 381 N.J. Super. 30 (App. Div. 2005); New Jersey Builders Association v. New Jersey Council on Affordable Housing, 390 N.J. Super. 166, 180 (App. Div. 2007); and Elcavage v. West Milford Twp., GRC Complaint Nos. 2009-07 and 2009-08 (March 2010), in order to specifically identify correspondence, OPRA requests must contain: (1) the content and/or subject of the correspondence, (2) the specific date or range of dates during which the correspondence was transmitted, and (3) the sender and/or the recipient thereof.

Dear OPRA Custodian,
Per Paff vs. Township of Galloway (2017) this is a valid request.
You fulfilled a request for similar information on Dec 21, 2023 seeking all email header information for domain wwrsd.org for the month of March 2023. My request uses precisely the same language as the December 21, 2023 request you fulfilled without extended parameters, only for June in lieu of March. You have already denied my prior request that contained specific recipients/senders and/or the sought content, and did so specifically for those reasons, claiming you do not maintain records searchable by those parameters.
Unless you can provide a legitimate reason as to why you are applying disparate standards to the Dec 21, 2023 request and my request, I will have to consider your response an unlawful denial and address the matter to the Government Records Council.
