Rent Control / ADAM / Substantial Rehabilitation Records
Dear Weehawken Township,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
I appreciate if you can please provide the following records electronically (if available):
1. Complete copies of Weehawken Ordinances 13-1981 and 3-1982, plus any later ordinance specifically amending or repealing their provisions concerning substantial rehabilitation or rent decontrol.
2. The current application form, instructions, checklist, written policy, or criteria for “decontrol of rents by reason of substantial rehabilitation,” and the three most recent final decisions/approvals/denials involving such applications, including any existing record showing the lawful rent before and after the decision.
3. Current ADAM Program application/instructions; any current record identifying how the maximum ADAM rent is determined under §12-3.11(h); and any current form or written procedure governing the 15-day referral process under §12-3.11(f).
4. For the period January 1, 2016 through present, any existing log, spreadsheet, database export, register, report, or summary showing:
* number of ADAM applications received;
* number approved;
* number denied/rejected and the recorded reason;
* number of ADAM units later disqualified, removed, terminated, or deemed ineligible; and
* the recorded reason for each such disqualification.
I am requesting existing records only and am not asking the Township to create a new statistical report.
5. Regarding Superior Court Docket L83504-87EPW, concerning Ordinance 10-1987, please provide:
* the final judgment, order, opinion, or written decision;
* any record identifying the case caption/parties;
* any later court order or appellate disposition affecting that judgment; and
* any ordinance or resolution adopted specifically in response to that decision.
Tenant personal information may be redacted. If any item is unavailable, please provide the remaining responsive records without delaying the entire request.
My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.
