Release of expunged records.
Dear North Haledon Borough,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.

Pursuant to the New Jersey Open Public Records Act (N.J.S.A. 47:1A-1 et seq.), I am requesting access to the following records:
Demands for Corrective Action:
1. A copy of the OPRA request with a written explanation of how and why my expunged record was disclosed (including the requester(s) name, date, and description of records sought) that resulted in the release of Andrew Coletta’s arrest record.
2. All correspondence, including emails, letters, or internal notes, related to the processing of that OPRA request and the decision of how and why you released the record.
3. Any records identifying the person(s) or entity to whom Andrew Coletta’s record was provided in response to that OPRA request.
4. Any legal opinions, memoranda, or communications from the town attorney DeMarco & Demarco specifically Michael P. DeMarco relating to the release of Andrew Coletta’s record under OPRA.
5. Written assurances that no further dissemination of the record will occur.
6. A copy of any policies or procedures governing records handling and expungement compliance.
Please provide these records in electronic format via email if available.
Releasing Andrew’s expunged arrest record is already a violation of N.J.S.A. 2C:52-30.
Response Deadlines:
This request is made pursuant to OPRA, and I expect a response within seven (7) business days, as required by statute.
If the Borough fails to comply, I will escalate this matter to the New Jersey Attorney General’s Office and pursue all available legal remedies, including civil litigation.

I am in receipt of your September 25, 2025 correspondence regarding my OPRA request submitted on September 15, 2025.
Please be advised that under N.J.S.A. 47:1A-5(i), a records custodian must respond to an OPRA request within seven (7) business days of receipt. In this case, the statutory deadline was September 24, 2025. Because the extension notice was issued after that deadline, the request is deemed denied as of September 24, 2025.
Additionally, OPRA requires that any extension notice set forth a specific reason for the delay. Your email did not provide such a reason.
While I note that you have indicated a new date of October 6, 2025, I must preserve all of my rights and remedies under OPRA, including the right to file a denial of access complaint with the Government Records Council or to initiate an action in Superior Court.
I respectfully request that the records be provided without further delay.

Thank you so much for your prompt response. Regarding your bullet point 2, yes I would like to have my unredacted original arrest listing I authorize it ONLY TO BE RELEASED TO ME IN PERSON AT HEADQUARTERS. Since it was expunged I would request it not posted here since that is not public information to be posted on OPRA. So that we’re not violating OPRA again. If this is an issue please let me know.
