Dear North Haledon Borough,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

Pursuant to the New Jersey Open Public Records Act (OPRA), N.J.S.A. 47:1A-1 et seq., I request copies of the following existing government records:

1. Any memorandum, legal opinion, email, directive, policy, or other record relied upon in determining that the requested body-worn camera footage from the May 1, 2026 meeting was exempt from disclosure under N.J.S.A. 40:14-118.5(c)(1).
2. Any records identifying the individual(s) who made, reviewed, recommended, approved, or authorized the determination that the requested body-worn camera footage was exempt from disclosure.
3. Any emails, text messages, memoranda, letters, notes, directives, meeting notes, or other communications concerning the decision to deny the requested body-worn camera footage between or among:
* Det. Sgt. Colleen Carver,
* Municipal Prosecutor Robert C. La Salle,
* Borough Attorney Michael DeMarco,
* Municipal Clerk Dana Cedar,
* the North Haledon Police Department,
* and any other Borough employee or official involved in the determination.
4. Any records reflecting consultation with the Municipal Prosecutor, Borough Attorney, or any other attorney regarding the applicability of N.J.S.A. 40:14-118.5(c)(1) to the requested body-worn camera footage.
5. Any records identifying the date the exemption determination was made and the person or office responsible for issuing or authorizing the denial.
6. Any records documenting the decision to deny an extension of the body-worn camera request, including any communications or directives concerning that decision.
7. Any records concerning the release, anticipated release, or conditions of release of the May 1, 2026 body-worn camera footage, including communications relating to the prosecutor’s written “Limitations on use of Body Worn Camera evidence” letter.
