Dear Mr. Snow:

The Township of North Bergen (the “Township”) received your request dated 03/04/2026 under the New Jersey Open Public Records Act (“OPRA”), N.J.S.A. 47:1A-1 et seq.

Township Response:

#1. Retirement Records: Any and all records relating to the retirement of Deputy Chief David Corbisiero, including but not limited to: retirement letters, resignation letters, separation agreements, settlement agreements, memoranda regarding retirement, pension submission documents, any personnel records documenting the retirement.”

Response: A request for, “Any and all records relating to” a particular matter or subject is an improper request under OPRA. See MAG Entertainment, LLC v. Division of Alcoholic Beverage Control, 375 N.J. Super. 534 (App. Div. 2005); Bent v. Stafford Police Dept., 381 N.J. Super. 30 (App. Div. 2005), Bart v. Passaic Cty. Public Housing Agency, 406 N.J. Super, and Lagerkvist v. Office of the Governor, 443 N.J. Super. 230, 237 (App. Div. 2015) (2007).
Subject to the impropriety of the request, the Township maintains no records responsive to, “retirement letters, resignation letters, separation agreements, settlement agreements,” or “memoranda regarding retirement” relating to the retirement of Deputy Chief David Corbisiero.

Concerning the request for “pension submission documents,” and “any personnel records documenting the retirement,” N.J.S.A. 47:1A-10 states that the personnel or pension records of any individual in the possession of a public agency, including but not limited to records relating to any grievance filed by or against an individual, shall not be considered a government record ... except that ... an individual's name, title, position, salary, payroll record, length of service, date of separation and the reason therefor, and the amount and type of any pension received ... shall be a government record. Responsive to, ‘salary,’ attached is a document entitled, ‘North Bergen Deputy Chief Contract 01-01-2024 through 12-31-2027.’ Also responsive is attached document, ‘Deputy Chief David Corbisiero Hire Date - Separation Date.’ Deputy Chief Corbisiero is a member of the New Jersey Police and Firemen’s Retirement System (PFRS)plan. The Division of Pension and Benefits has not yet made a determination or final calculation on the amount of pension to be received, and accordingly, the Township has no records responsive.

#2. Internal Affairs Chain of Command: Documents identifying the chain of command and supervisory authority for the Internal Affairs Unit within the North Bergen Police Department from January 1, 2024 to present.

Response: Attached please find responsive documents entitled, ‘General Order 20-03 Internal Affairs Policy,’ and ‘North Bergen Police Rules and Regulations.’

#3. Internal Affairs Complaint Log
The Internal Affairs Complaint Log for the North Bergen Police Department from January 1, 2024 to present, including: complaint number, date received, classification of allegation, disposition.

Response: Your request is denied pursuant to N.J.S.A. 47:1A-1, and N.J.S.A. 47:1A-9 (Section 9.6.1 of the New Jersey Attorney General Directive 2020-7, Internal Affairs Policy and Procedures). Section 9.6.1 states that the nature and source of internal allegations, the progress of internal affairs investigations, and the resulting materials are confidential information and remain exempt from access under the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1.1 to -13. “The Internal Affairs Complaint Log,” as required pursuant to Section 9.3.1 is a component of the mandated filing system as defined in Section 9.5.1.

#4: Internal Affairs Policies: The Internal Affairs policies and procedures currently in effect for the North Bergen Police Department and any versions in effect since January 1, 2024.

Response: As provided responsive to your request #2, attached please find responsive documents entitled, ‘NBPD General Order 20-03 Internal Affairs Policy,’ and ‘North Bergen Police Rules and Regulations.’

#5: Deputy Chief Position: Any documents discussing the filling of the Deputy Chief position within the North Bergen Police Department following the retirement of Deputy Chief David Corbisiero.

Response: The Township holds no records responsive.

#6. Command Staff Organizational Chart: Any organizational charts or documents identifying command staff structure for the North Bergen Police Department from January 1, 2024 to present.

Response: Attached please find responsive documents, entitled ‘2024 Command Staff’ and ‘2025 Command Staff.’

#7. Settlement or Separation Agreements: Any settlement agreements, retirement agreements, separation agreements, or resignation agreements entered into between the Township of North Bergen and any sworn member of the police department from January 1, 2024 to present.

Response: The Township has one responsive record pertaining to Kayleen Ocasio that is exempt pursuant to N.J.S.A. 47:1A-1.1 and N.J.S.A. 47:1A-10 (grievance).
