Please note that the information you have requested, namely " emails, memoranda, and other reports" related to Laboratorios HIPRA SA and Arnau Nogareda regarding the purchase of real estate will require to coordination with a few departments as well as review the documents for any duplication, confidential or non-relevant information which may need to be redacted. Therefore, we are requesting an extension of 30 days or until June 12, 2023 for our response.

As you aware, Rowan is working on your May 11, 2023 OPRA request. You requested, all "emails, memoranda, and other reports" related to Laboratorios HIPRA SA and Arnau Nogareda. I just heard from the IT department that the email search has resulted in over 2.8 million hits. In light of this, we will need you to narrow your request. In Elcavage v. West Milford Twp. (Passaic), GRC Complaint No. 2009-07 (April 2010): The Council held that an OPRA request for an e-mail or e-mails shall focus upon the following four (4) characteristics:
- Content and/or subject
-Specific date or range of dates
-Sender
-Recipient
Id. at 5. See also Armenti v. Robbinsville Bd. of Educ. (Mercer), GRC Complaint No. 2009-154 (Interim Order dated May 24, 2011) (applying the Elcavage, factors to other forms of written correspondence).

Pursuant to my previous email, the deadline for Rowan's response was extended to June 12, 2023. Please note, Rowan University's response time is suspended until we hear back from you. Once you provide us with the new search terms, we will be able to do another search which will give us a better idea of how much time we will need to provide a response.

Good morning,

The IT department is still working on narrowing the search. As of today, they have only been able to narrow it down to four thousand hits. As you can imagine, this would take weeks and an extraordinary expenditure of time and effort to review, organize and redact any non- relevant or non-disclosable information. Under these circumstances, OPRA allows public agencies to impose special service charges whenever the nature, format, manner of collation, or volume of a government record embodied in the form of printed matter to be inspected, examined, or copied pursuant to this section is such that the record cannot be reproduced by ordinary document copying equipment in ordinary business size or when fulfilling a request requires an extraordinary expenditure of time and effort. See N.J.S.A. 47:1A-5.

Over the next two weeks (while I am away), the IT department is going to continue working on trying to narrow the search to a more manageable number. Once I get back, I should have a better idea of whether the IT department was able to narrow the search. At that point, I will be able to give you a better idea of what, if any, charges there may be. OPRA mandates that the requestor (you) has the opportunity to review and object to the charge prior to it being incurred. See N.J.S.A. 47:1A-5.c. Once we have your approval, we would proceed with getting everything together. Please note that, if there is going to be a charge, we will not produce any information or begin any work until payment is received.

In addition to the above, we will be able to advise you of how much time will be needed to complete the review once we have finalized the search. If you want to narrow the search any further, please let Mr. Gargano (who is copied on this email) know. He will forward it to our contact in the IT department while I am away.

Good evening,

Please accept this as Rowan's partial response to your OPRA request (below) wherein you sought "records (including but not limited to emails, memoranda, and other reports) related to Laboratorios HIPRA SA, its representative Arnau Nogareda, and its purchase of real property at the South Jersey Technology Park - Mantua Township, Block 261, Lots 16.01 and 17.01. This includes discussion of items 2016.06.47, 2017.04.28 and 2017.04.29 presented at the Board of Trustees meetings on June 15, 2016 and April 5, 2017." Attached please find Authorizations/Resolutions as well as the Board Of Trustees' Minutes for the meetings for June 15, 2016 and April 5, 2017.

The IT Department was unable to narrow the search any further. As it stands, there are approximately four thousand hits. We will need to hire someone to review, organize and redact any non- relevant or non-disclosable information. Due to the large number of hits, we estimate that it will take this person about 15-20 business days at 4-6 hours a day. The hourly rate will be determined by who will be doing the work. Once we have your approval to move forward, we will look into hiring someone to do the work.

We are open to any suggestions you may have on narrowing the search.

Please advise how you want us to proceed. If you do not wish to move forward with this portion of your request, please advise and we will close the file.
